    has anyone been to court with there bank or building society over mortgage penalty charges?

    claimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£5482
  • I have had a successful claims paid out against my bank (nationwide) because of the returned direct debit charges that were debited from my account. (30 pounds a time)

    The Abbey also added 35 pounds to my mortgage everytime a direct debit was returned but I never persued any claims against the Abbey.

    Does it count as the same thing or is a mortgage account different and is it still worth starting a claim at this late stage?

    i dont see charges on a mortgage as being any different to bank charges.

    however Chelsea seem to be taking it more seriously than any of the banks or credit cards ive persued todate.

    awaiting court date so ill let you know what happens

    I have just started to look into claiming my mortgage charges back for the past 3 years with Northern Rock, I know they are going through a bit of trouble at moment but dont see why they should still be allowed to charge what they like when they like, they tried charging me £25 per statement when I asked to have them sent out so I could check charges from the beginning but I got around it by asking for a list of all charges instead, they then said they were taking me to court as this months mortgage payment was late, its only 2 weeks late! but fortunately I got them to drop it. Payment was in the post anyway!

    hi over 5 years i have had 65 pounds arrears fee each month for arrears so 4,000 in total paul
  • There are some posts on the Consumer Advice fora which I read the other day saying Halifax have been crediting mortgage charges with no fuss, no legal kerfuffle etc. No news on my own claim yet but hoping for similar results! I will update as and when.
  • Does anyone know if the same rules apply to Mortgage account charges. My direct debit bounced due to insufficient funds, but I rang them as soon as I noticed and paid by visa. They want me to pay £32 for a returned direct debit.

    I sent the first template letter requested all charges back from my previous mortgage company. They refused to refund any of the money. I have now sent the 2nd letter threatening further action. My question is has anyone had any successful claims against GMAC?

    Any help appreciated.
