    the claim is unlikely to exceed the 25K but even so theres still the common law of penaltys for breach of contract. The UCTCCR may still also be revelavent too.

    my personal fave method of claiming back these outragious charges is common law anyway.

    Just to let you know i have been succesful in claiming for charges for late payment fees on a mortgage a total of over £500.

    there is a statutory limit of 6 years. the court case could take upto 3 years. bear this in mind. The court case is specifically relating to bank charges so will not give a definitive answer on mortgage penalty charges. ultimately you may still have to take it to court the same as people still do for Credit card penalty charges.

    Hi,haven't posted for a while,but I am now trying to claim Bank,Credit Card and Loan charges back.Hopefully this should reduce my debts.

    I was just wondering,with bank charges there is an acceptable charge amount of £12.00,the same with credit cards.Is there an acceptable charge wth loan and mortgage charges?

    On one of my loans,I was charged £10.00 for every late payment reminder,is this an acceptable amount and would I be able to claim this??
  • Back in 2002 I took out a loan through a shop over the phone to buy some Alloy wheels at a cost of around £450.00 (Loan provided by Halifax Cetelem) . I made the first few payments fine with no problem. I then ran into difficulties and lost my job, couldn't pay creditors and moved back in to my parents address.

    I entered into DMP with all my creditors.. except this one, which totally slipped my mind, not sure why but it did.

    Anyway, about 3 years later I get a letter from 1st credit claiming on behalf of Halifax Cetelem a grand some of £2900.00 , I thought that was a little excessive so I argued for a long while, they refused to send me statements showing how it got to that amount until one day they did, it showed how the debt rose from being £450 in credit to being about £500 in the red due to missed payment charges of about £45.00 or so. over a period of year. I still don't understand to this day how the debt got to £2900.00. Well I finally agreed to pay them a lump sum of £400.00 and then £45.00 a month until the debt is cleared. This one done over the phone. I have been paying them the £45.00 now for over a year or so, until i decided that actually this was unfair, i have repaid the original debt by more than double now. The account isn't on my credit file anywhere .. what should I do.. more to the fact, what can i do at this stage?

    Any help would be great here. Thank-you.

    just wandered if it was possible to claim missed loan and mortgage charges and if it is wise to use the standard bank charge reclaim template letters(obviously changing details where needed) thx in advance for any help

  • Log book loans have charged me £12.00 a week and also £12.00 for phone calls they have made to me, these calls were to confirm i was making my usual payment on a thursday !!!! I took out the loan and explained i was paid monthly, as they are a company who do things by the week when i made my first monthly payment I was three weeks in arrears, as yet I have not been able to make a double month payment, so still receive these letters on occassion even though I have rang them a few times to confirm what date i will make my payment

    Are these charges unlawful as it works out at £48 per month in charges but have they found a loophole by doing the £12 charges weekly

    PLEASE HELP

    Sorry but when you took out the loan you knew it was weekly payments so why are you complaining about being charged late payment fees?
