    I have seen quite a few times on the forums that for MORTGAGES you can go back 12 years rather than the 6 for Bank Charges.

    I had some charges applied to my GMAC mortgage when I had some arrears. They charged me £50 / month for 'administration'. Can I claim these back?
  • Hi all, I am trying to find out if the bank charges rules apply to loan companys too?

    I took out a loan for £1500 paying £112pm over 2 years, this was 3 years ago, and they claim I still owe over £2000 due to late payments. Can they do this?

    I also have the same issue with my car finance from the same company witch should be comming to the end of the agreement in 6 months, but for the same reason the are claming I still owe £6500. (there was no lump sum at the end of the agreement like HP)

    Is this alowed? Can anyone help, advise or point me in the right direction to find some answers

    Late payment charges can usually be challenged as penalties if the seem exorbitant. Certainly £2000 worth fits that description.
    These are not bank charges rules, it is the law which applies to everyone. If you breach your contract, the other side may recover their costs/losses, they may not charge punitive penalties with a view to a profit.

    As far as im aware ANY claim is subject to the 6 years statute of limitation. if someone knows different please post.

    my own mortgage charges claim has just finished being on hold for us to try and agree, having not agreed im awaiting the courts next instruction.

    I'm new to the forum and i'm lost in the amount of posts there are.

    I would like to know if I'm able to claim back late payment charges and admin costs from GE money from a secured personal loan I used to have but is now payed off and closed. I still have the account details. does anyone know where I need to write and ask for details of charges and which template letter I should use??

    Also I have debt with Additions Direct which is the Argos clothes catalogue. The debt is now with a collection agency and I'm in a £50.00 a month agreement with them. Am I able to claim late payment fees and over limit fees for this card as there will be lots?? Does anone have any idea where I need to write to to ask for the details of the charges and which template letter I should use??

    Any help will be greatly appreciated.
