With the ruling on the banks this week, how does it affect other financial organisations. We had a really bad experience with Kensington Mortgages and they kept making ridiculous charges for unpaid direct debits, missed payments, etc. The are a horrible company to deal with anyway, but if they fall into the same category as the banks, then I think it might be worth trying to persue the fees again - done it once, but they said that they weren't a bank, so the rules didn't apply to them!!
Thanks anyone0 -
hi
mortgages are not banks, but as you say the principle is the same. im currently awaiting a court date with chelsea buildings society for there aggresive penalty charges. i based my claim on the standard letters and particulars of claim but obviously adapted it to mortgage penalties not bank charges.
the mortgage i had after chelsea was with kensington but fortunately our finances were better by then and we never saw their dark side. the SAR data they sent was outstanding tho best of any ive had.
good luck

hi
sorry youve also had problems with kensington. but be aware all banks and building societies have the same charges. you need to ensure you dont incur charges as they will all take them. its easier to avoid them than to recalim them.
im on no moral high ground here ive suffered charges from banks and building societies.
good luck in reclaiming

Hi all,
Just a quick bit of advice please...
first thanks alot cos I managed to reclaim £1000 off the halifax for unfair bank charges last year on my husbands current account (hurrah!!)
second, can you reclaim charges added to your mortgage account for arrears ?? When our monthly mortgage payment changed we forgot to change the standing order to the new amount and have now been charged £35 by the Halifax. Is this reclaimable??
Ta for your help x0 -
I used to have a combined mortgage/bank account with Britannic Money (now Mortgage Trust). As a result of the hugely complex rules for the operation of this account I inadvertantly incurred some charges, called variously "arrears administration fee", "exceeding withdrawal facility fee", "unpaid fee", "mortgage payment not made fee".
I took it that these were "bank charges", but a letter from Mortgage Trust in response to my claim states they were "charges and fees levied on the account because of my failure to meet my contractual obligations".
I can't see these accounts mentioned in the articles or forum about reclaiming bank charges. Have I missed something? Are they considered to be bank charges?
