    I was charged hefty fees by my old mortgage company so decided to take the steps to issue a court summons.Ive followed the template letters that you used for the bank charges refunding and now the mortgage company have filed a defence.I get the feeling this will go to court,the total is around £2,000.
    I had all my bank charges refunded recently and the whole process took about 4 weeks from the court summons being issued.
    Im now worried that the mortgage company will fight me in court and little old me will lose against them.I dont feel confident at all.

    Can you give me help with this?

  • I have just had a telephone conversation with GE Money Home Lending. I have discovered that i have been charged £839.14p in administration charges due to having arrears of £258 on the account.

    Can someone let me know if i should/Could make a claim to have these charges returned on the same grounds as bank charges being unlawful.

    I understand that i am in arrears but think that this is a bit excessive for admin charges.

    I am able to keep up the current payments but not to clear the arrears. If i can claim i think that this would be a great help to me.

    I have been told who to write to but i don't know what to write. Is there a template on here for this type of claim.

  • hi gray , im wiv ge money to and basically, my morgage is due out on the 10th of every month i phoned up and was told to change the date to the end of the month will cost £150 , so every month i get charged £40 for admin fees , was looking for a thread to see the answer to my question like urs, couldnt find 1 so ive come on urs lol lets hope sum 1 can answer us both cheers jill
  • Yep thats it £40 quid for nothing. The worst thing is that i had an arragement to pay off the arrears and they still charged me.

    Lets hope someone can help.

    Sorry if this is in the wrong place, please feel free to move it. (I have also put in on the debt free wannabe board).

    I have carried out a search, but can't find a definite yes or no.

    Is it possible to claim back fees charged when a mortgage has gone into arrears.

    I am with Halifax and while looking through some paperwork, found an old mortgage statement from 1999:eek: . This shows 2 unpaid direct debit fees of £20 each and 2 arrears admin charges of £21. I am sure there have been many more since and also that the cost has increased!!

    I have read that it is possible to claim back for 12 years worth of charges, but then got confused as I read somebody saying that they lost, and had to pay the Building Society's fees!! But, it mentioned ERC as well as late payment fees, so not sure which applies.

    Hope someboy can help.

    Hi Carol,
    I already put this question in a few weeks ago and never got any further forward. I have had a few charges added over the years, with a couple of different companies, one being the Halifax. I shall keep an eye on this thread and hope that we get some response this time.

    Every time i miss a mortgage payment, my mortgage provider, Nat West Home Loans, send out a standard letter informing me that i have missed a payment (like i need reminding!!) and charge me (currently) £35 for the privilege. This they then add on to my mortgage.

    Am i right in assuming i can claim some of this money back the same as bank charges and should i hit them with the standard letter to start the ball rolling?

    Sorry to sound a little dim on the subject but these charges seem awful unfair to me..
    What im after :-
    Barclaycard £201.30 - Received £226.30!!
    Barclays 1 £614.03
    Barclays 2 £1011.23
    Its a shame you cant go back further than 6 years... I would OWN Nat West!!!
  • Would I be able to reclaim charges back from Northern Rock. They are the mortgage provider for my buy to let mortgages (I do not have a bank account with them) and I have had real problems keeping up to date with the mortgage repayments. They have charged me for: Arrears Charge, Payment Option Fee, Debt Counselling Services (although I never got a service like this!).
    I am now up to date with all my payments to them.

    I hope I'm not being too thick here but I can't find anything (specifically)about this on the site. Can I reclaim charges on a mortgage account? I'm not talking about redemption fees and such like, I'm talking default and admin charges just as the same as on a bank account.

    We have our mortgage with Halifax (sadly) who have very kindly charged us the sum of £35 in order to send us automated letters on several occasions over the last couple of years. I pay my mortgage manually every month (owing to the fact that Halifax seem unable to set up a working direct debit from my bank account despite four failed attempts). Occasionally circumstances mean I pay it a day or two late (but I still pay it in full, I hasten to add), and lo and behold, Halifax charge us £35 ("Arrears Letter/Call Fee") to send me a letter telling me all about. On three occasions, they've added a £40 charge for - and I quote - "Failed Promise".

    I have the list of "arrears administration charges" which they sent me this week (admittedly very quickly, in fairness). It totals £475.00 since June 2006 which I find utterly disgraceful.

    Can I reclaim these charges?? Is it the same situation as with bank accounts, i.e. on hold?

  • You can claim in the same way as bank and card charges but it is not subject to the test case as they are like the credit card charges, outside the scope of the test case. Use the template letters as normal.
