    They cannot "fine" you and if he used that word he was wrong. It is a speculative invoice asking you to pay which you do not need to. Just ignore all the letters you receive, they have no power to do anything.
  • I picked up in a supposedly restricted area (I had no idea though) particularly given the person I picked up was waiting on the roundabout (no cars around and they had no luggage). I have now received a letter headed "Parking Enforcement Notice" charge of £80 reducing to £40 if paid immediately. My question is it cant be scam as I was there, albeit unaware of such restrictions. Should I just pay or is it unenforceable. I appreciate this may have been answered already but given they are changing tack I wanted to be sure.

    It's still unenforceable. You must remember that this comes under civil law which states that they can only claim for the actual material loss suffered by the landowner. A private company such as this has no right to penalize another private citizen.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?
  • Interesting though I also had an office premise. We put a notice up that anyone parking on its private land will be fined (managed by third party company). If a vehicle did park there without permission it was clamped and they paid for the priviledge of removing the clamp.
    That said it backfired on us as they clamped one of "our" vehicles and charged us to remove it. I sacked them.
    Point is how did they get away with that?

    Yes once again the genius of APCOA Luton Airport is revealed...on a recent visit I noticed that the £1 area has been re-signed. The new signs make it quite clear that the £1 zone is for drop off only NOT pick up ...so you can only pick up by paying to park in the short term car park ..what a rip off stitch up !
    Ignore the nonsense they have sent you.

    That said if you went into court (not happening btw) and said you were not aware that you could not pick up where you did you would be in some difficulty as there IS ample signage. So unless you can not read English that is a very very weak defence .

    They got away with it because they could - because the clamp meant people were forced to pay. Gawd knows why your management actually thought it was a good idea to let such knuckle-dragging scumbags in your car park though, with their protection racket and threats. Their agenda is solely money, as you found out, it is never in their interests to solve any parking problem. With clampers, in the end they always end up clamping people who are allowed to be there.

    But where we are not talking about clampers, a fake PCN scam is easy to ignore. And it IS a scam, always.

    Have you read the sticky threads at the top of the forum, seen the letter-chains, seen the amusing Watchdog video linked there? Look at the sticky threads by Crabman and once you have seen the rubbish demands PPCs send out and watched the Watchdog solicitor you will realise that it is all a money-making con. Doesn't matter that you were parked there, doesn't matter whatever the circs; it is ALWAYS a scam - just like your clampers were allowed to carry out.

  • Just received a Parking Enforcement Notice today (29/10/11) dated 29/9/11. It came through my lease company. States contravention of 02- dropping off/picking up outside a designated parking area at Luton Airport.

    This is the second one, paid first, both relating to the same day.

    What should I do???
  • Normally we say just ignore, but in this case make sure the hire company will not pay any future tickets for you and then ignore.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    And have had the Roxburghe letter today. I have an image of it scanned to photo bucket (with personal details deleted) but can't link it as a new user. But if anyone can tell me how to share it I happily would.

    Is the advice still to ignore it?

    Has anyone gone to court yet who posts on here for this?

    If I was really unlucky and was the first to be prosecuted would I have a leg to stand on in appealing it? What defence should I use?

    What should I expect next?
