Seconded, no different at all Vaillant. The clue is in the fact it hasn't come from an authority (Council or TFL or Police) and does not include the word 'penalty' because they are not allowed to.
It's just a rubbish APCOA invoice like any other when not issued on behalf of a Council. (I do know APCOA also work for some local authorities but that would be a real 'penalty charge notice' and you'd see a Council logo which you don't get on these 'impersonation of a parking/moving traffic ticket' fake versions).PRIVATE 'PCN'? Hi all,
After making the mistake of stopping for a few seconds to let someone out close to the roundabout at Luton Airport, I was lucky enough to recieve an £80 'invoice' letter from these cowboys, which I have no intention of paying.
However while searching around I saw somewhere a comment that the law was changing from 1st of October regarding notifying them who the driver was. Does anyone know what this change was and how it may affect these notices.
I have also noticed that they have infact put the wrong reg number on my letter which does not relate to any car I have ever used so they are never likely to get anywhere with persuing this even through court.

The new law states that if the PPC do not know who the driver was (and the RK should be invited to impart that information, but doesn't have to if he/she doesn't want to) then they may pursue the registered keeper with an unenforceable invoice, instead of pursuing the driver with an unenforceable invoice.

Well they've obviously got your correct reg. no. otherwise they wouldn't have been able to write to you.
The law change on 1st October specifically relates to parking. Stopping on the infamous Luton Airport roundabout to drop someone off is not parking, so the new law doesn't apply.
I would love to know the exact text of the letter you have received, whether it makes reference to POFA or POPLA, and whether it states that the registered keeper is liable for the charge unless you tell them who the driver was.
If it says any of that then it is very, very wrong and should be the subject of a formal complaint to DVLA about the misuse of data obtained from them by APCOA. There are those here who specialise in complaints to DVLA, they will be happy to help with this. Getting APCOA banned from DVLA data access would be quite a coup!
As for APCOA, just ignore them. There is not a snowball's chance in hell of them going to court, all you'll get is a few scam letters all of which you should ignore.Je suis Charlie.0 -

Please to post up the "invoice" you have received from APCOA (scrubbed of your personal details). We haven't seen a post October 1 version of their tickets, so it would be interesting to see how they skewer themselves.
As stated, you weren't parking, so they can't issue a Parking Charge!0 -

As promised here is a scan of the letter from APCOA, I have deleted all identifying info. I have also realised they have entered the incorrect date and time of the alleged offence on this letter too.
