Apoca parking fine Luton Airport info needed please

  • I have registered on this site just so that I can say thank you to all of the posters here who said to ignore the letters and threats. Earlier this year, I dropped someone off at Luton Airport. I was only stationary for seconds as I said goodbye and a week or so later I received the first parking 'fine' (actually parking charge).

    I took the advice on here, ignored the letters and increasing charges and did not enter into ANY correspondence. The last letter was the one offering the discount, which I ignored and the letters have now stopped.

    My wife has just received one from Euro Parking for overstaying at Morrisons and I am now looking to check that this is a similar scam.

    Anyway a big thank you to you all. :T

    Private parking ticket = scam, no matter the circumstances. So you can ignore this as well.

    Its the same deal, apart from the fact that they might quote the Protection of Freedoms Act at you, if the Morrison's ticket was post Oct 1st. All this means is that if they do not know who the driver was and the Registered Keeper doesn't tell them, then they might well hound the RK with the letters instead of the driver.

    Its all still unenforceable tosh though.

    Just received our 1st APOCA 'Parking Charge Notification' and i think i have just read every post to my other half to convince him not to pay.
    Opened it this morning and went to pay but then thought hold on lets search this name..so glad i did.

    Just to update Taffy et all. I have recently had a second letter from APCOA in which they apologise..

    "Due to a technical error the parking charge notice was incorrectly issued, the ticket has been cancelled and no further action is required."

    To be honest I am quite dissapointed, never even go to demanding letters from their 'solicitors'

    Valliant. Don't give in to thier false demands, they have no legal right to expect this money from you, regardless of what they say. They have no authority to charge you money in this way. Either as a parking charge or as fake solicitors cost. :cool:

    Just wanted people's opinion.

    Dropped the missus off at East Midlands last night and noticed these signs as pulling away, £100 for stopping, which I did for a few seconds.

    I wouldn't think twice about not paying this but I have a company car, so if they go through DVLA then it will go to lease company, my head office and then my office. I'm concerned that the lease company will pay thinking that they will just pass on the costs to me through my company, as this happened once before with a council ticket as the council ticket wasn't on my windscreen when I returned (warden had photo of it on there though).

    My thoughts are to e-mail my HR and give them advance notice that I won't be paying so that they can inform the lease company of same, just slightly concerned that this is in some way an admission, would welcome any opinions.

    Eeeeek! You need to do more than emailing your HR (but do that too, with this link = clicky for BVRLA trade body advice re giving driver's details under the Protection of Freedoms Act). Tell them that the link is for the info of the lease company and giving your permission for them to give your details if they do get any letters, and as this isn't even a real fine, TELL THEM categorically that it's not covered as a fine/penalty within your car use t&cs. Do not be too wishy washy with that email, be assertive. :eek:

    What I would also do is look up the parking company (APCOA?) online and find their 'contact us' email address.

    Email right now and ask if there's a 'PCN' against your car as 'the driver' wants to appeal immediately if there is one. Give the car reg, the place/time and state that you saw no signs before you stopped (do NOT say you saw a sign afterwards). Maybe say your 'friend' had a PCN there so it made you wonder today if there's one being prepared for this car - and that the express purpose of this email is to give them the driver's details. Give the details up front (give them your name and a postal address, that's all they need and make sure you state that these are the driver's details).

    If they say yes there is one but 'wait till it's posted out', tell them that they cannot lawfully do that because YOU were driving in fact, and therefore under the Protection of Freedoms Act they have to deal with you now they have your details as driver. Say that they must ONLY post it out to you now that they know who was driving - there is no other option for them in law now.

    Tell them that they now have NO reasonable cause to get the registered keeper's data and if they do then they will have broken the BPA Code of Practice and the DVLA terms of obtaining data. Not only will you sue them for damages if they cause you any loss - but point out that you have copied in the DVLA already so that the DVLA KNOW there is no reasonable cause for this data relase.

    Copy in [EMAIL="foi@dvla.gsi.gov.uk"]foi@dvla.gsi.gov.uk[/EMAIL] and like I say, draw attention to this 'cc' in the email to APCOA.

    Never mind an admission - a fake PCN from APCOA ia nothing to be concerned about! What is concerning is that your lease company are likely to just pay this or at least pass it on to your company and clout you with a hefty 'admin fee' for handling the invoice (and possibly an admin fee for every letter they get!). So you MUST stop the lease co getting the letters. We have seen this scenario before and you must be proactive in every direction right now - DO NOT rely on your HR person.

    Many thanks for response and advice. It's a slight catch 22 situation as I don't even know if my stopping was recorded.

    However have chased up HR with the notice below, e-mailed APCOA but their only contact details are an online form, so no record.

    I did manage to speak to people at GE, and have had to explain to everyone about the difference between a parking charge notice and penalty charge notice. I have e-mailed my details to GE and they have said that they will pass on any notice to me at my home address. Worryingly they checked their contract with my employer and said the default was to pay and then re-charge, though slightly changed their tone when I pointed out that this was not a fine.

    Will advise further of any developments.
