    Everybody keeps forgetting that the laptop was only a month old though.
    I don't see what me not backing up a month old laptops data has to do with this anyway? The fact is that Comet promised me that the data wouldn't be wiped, then they went ahead and did it.

    Exactly how much data was on the laptop if you'd only had it a month? Surely you can't have lost that much. The data has been lost, it's a tough lesson but ultimately if the data was important to you, you should have backed it up.

    I think you need to start accepting some responsibility. You moaned in your other thread that your boyfriend was pressured into buying the 2 year warranty, but if he hadn't purchased the warranty you wouldn't have been able to make a claim for the damage to the screen.

    You need to accept that the data has been lost, your boyfriend purchased the laptop and warranty and he's the one who needs to write to the CEO.
  • I haven't read all the threads or posts but it seems to me that if Comet were asked first and they said they wouldn't wipe the data then went ahead and did it anyway without informing the OP first then surely that is wrong irrespective of what the OP should have done?

    If I put my car into the garage for a repair and my tank is full of petrol and I ask them not to drain the petrol tank then if it turned out that it needed draining I would expect them to contact me first to say look, this job requires draining the tank so do you want to syphon it off first then book it in for another day?

    If they had went ahead and did it after me telling them not to or them telling me originally that it was not neccessary then would it be my fault?

    What is the difference here?

    The difference is that you could request the garage to return your car with a full tank of petrol. The op can't ask for the data back. If I wanted a purse repaired I wouldn't leave my credit cards in it when I hand it in would I? If it's important then take responsibility and don't expect others to care about your property or data in the same way you do.

    In addition, in her other thread the op claims that the laptop was beyong economical repair and Comet and had written it off which is very different from deleting the data. At that stage she should have advised them that the data hadn't been backed up and asked them to return the laptop to her so she could retrieve the data, she doesn't appear to have done this or made any attempt to ask Comet to assist in data retreival.

    I'm sure Comet will say in their T&Cs that data should be backed up before a laptop is handed in for repair. You should probably read the whole thread and the other thread and you will see that the op doesn't appear to take any responsibility for anything that has happened here.

    Why is everyone so preoccupied with the fact she failed to back up her data!!!!! i can assure all of you she is far from alone in that, I get phone calls on a weekly basis asking if i can recover peoples data on a crashed PC because they failed to back it up!!! I personally have a robust process for backing up, that involves the original hard drive, a mirrored array hard drive and further 3rd drive, but even that is not foolproof!!!

    The fact of the matter is that Comet told the OP that they would not wipe the data and that it would be returned with the data intact, the OP took her broken laptop to somewhere that claims to be professional, and as such she accepted what they said based in the fact they are supposed to be the professionals and that is what she is paying for.

    Now get over your holier then thou attitudes will you, not one of you will have a fully robust and foolproof backup system in place, I can guarantee that.

    I don't think the rant was called for:eek:. I have tried to help the op, but ultimately she is responsible for her own data, she only had the laptop a month so I doubt she lost that much anyway.

    While I may not have a foolproof system in place for backing up data I certainly would not have relied on the word Comet that my data was safe.

    You can check with them if the warranty has been transferred into your name or not. If it has, then the CEO CAN deal with you. If it hasn't, your partner needs to write into them, explaining he bought the laptop on your behalf and the warranty should be in your name.

    As for them wiping the hard drive, can you get it back? And take it to someone who maybe able to recover it for you? I believe someone once said, unless a hard drive is demagnetised (sp) an wiped several times, the data is always recoverable?

    I can guarantee I have so why not wind your neck in!
    My PC's and laptops are all back-up through my corporate server.

    At the end of the day, I've been treat dreadfully by Comet but people like you seem to think it's clever to post useless comments like this?

    Your initial complaint was that Comet are a bunch of theives and liars and had ripped you off, they pressured your boyfriend into purchasing an extended warranty, which you are now claimming on! and that you were being prevented from buying a laptop on line with the voucher from Comet.

    I believe I have contributed to this thread, I advised you that your boyfriend as the owner of the laptop needs to write to the CEO, sent recorded delivery etc, that you were unlikely to get a sympathetic response from Comet if you continued to call them liars and thieves etc. You also stated in your other thread that comet had said the laptop was beyond economical repair not that they had wiped the data, at that point you could have asked them to retrieve the data, you didn't

    You have chosen to ignore a lot of good advice given on here by myself and others.

    I am not one of those people who think you shouldn't complain if you have received a faulty item or poor service but I do think you should complain in writing stating the facts and providing evidence to support your complaint. Getting thrown out of shops, calling Comet staff liars and thieves on a public forum and attacking those that have tried to help you won't get the matter resolved.

    I am now butting out of this thread, I believe that I have given you some sensible advice which has worked for me many times over. Unfortunately, I don't think you want sensible advice you want everyone to be as outraged as you are. I'm sure none of us think Comet have handled this well but I think you have probably antagonised the situation in your handling of it.

    To summarise

    • Comet have no contract with you
    • You've made a claim on a warranty the salesman pressured your boyfriend to buy
    • You (or your mother) broke the laptop this wouldn't be covered under the normal 12 month guarantee
    • Comet disposed of the laptop, that doesn't mean they deleted your data
    • Responsibility for backing up data rests with you.
    • Complaints need to be handled in a mature professional manner in writing so you have evidence of your complaint and sent recorded delivery.
    I wish you luck in getting this resolved.
