Thanks essex, I received their defence this morning in the post. The infamous Nick Davies has signed to say that the dispute has been resolved and the account cleared in full.
However, I'm not happy that they took money from my account when they weren't providing me a service. I've written Louise a reply to her original letter informing me of the voiding of the contract, which goes a little something like this -
Thank you for your letter dated 19th June 2008 regarding the closing of my account with you. I note that I am now released from the contract and any payments requested of me in future have been voided which I am pleased to hear.
However, I am not satisfied that I have paid for 3 months worth of broadband service from Redten Internet which I did not receive. I did not cancel my direct debit as I was afraid of the damage it could do to my credit history and you continued to take payments in April, May and June even though my broadband service was ceased on 10th March 2008. I would therefore request that a total of £59.97 be returned to me, via cheque or bank transfer, as soon as possible as these payments were taken by you for a service that I was not getting from you.
I also request that the court costs of £35 for raising the claim to you be paid by you, as I have no doubt that had I not served these court papers, this account would not have been dealt with.
That makes a total payment of £94.97 for costs that have arisen from the bad customer service I have experienced from your company and Redten Internet. I believe I am within my rights to request this amount for the inconvenience I have had to endure throughout this whole situation.
If this matter is not resolved to my satisfaction, I will have no option but to continue my court claim against you to recover this amount.
Sincerely,
I've got a month to reply to the court, so that gives me some time to play the waiting game and whether or not to go ahead to court, I won't, but still, it's nice to make them sweat :rotfl:I only want the money they took back, that's all, but I might aswell try for the court fees aswell. Was gonna request the 3 months alternative broadband service aswell, but thought that was pushing it a bit :rotfl:
Nice but remember Clode do monitor this thread !Who cares ??0 -

If I had got as far as you have I would continue for the return of money paid for a service not received, you have already paid the court fees so not a lot to lose, don't let the cheat you, if you received no service then they owe you £60

Received my court papers today, nick has filled defence, writing that he denies that lesser service was provided. what a blatant lie.
so will see him in court I believe.0 -
Be Careful, in fact be very careful, they seem to be as slippery as redten, and equally as ruthless, the Fast internet brand has a long history of poor customer relations, and from my own dealings with them when I was trying to get a mac code, they were stupendously awkward, in fact they can wallow in the fact that during the whole of this fiasco, they are the only ones who I lost my rag with on the phone, and actually swore at the idiot (professed to be the customer relations manager) on the other end of the phone.
My advice is get your Mac and get the hell out of the circus, fight for your money back from another providor if you need to.
Good Luck with whatever you decide, but choose wisely.

My experience of Fast4's customer service has thankfully not been as bad, but I just hope I can get my MAC without having my line ceased, like they did with someone I recommended them to. :mad:0 -
Asked for MAC yesterday..no internet from 10:21 am today..now very angry !! Wont even consider giving 1second more business let alone 1 month on a new contract..beware of loss of internet the second you ask for a MAC. Still was going to lose it at the end of month just annoyed by their blatant tactics to remove prepaid users ( they prob make no more money from us)0

Referring back to my previous post on Terms and Conditions being materially different from those in the original contract, it would appear that the following extracts which were sent to me, are from the new terms and conditions of the fatcat service, if they are indeed part of the new T&C the restrictions are horrendous, no BBC I-player downloads as they are peer to peer, no large file swaps of say video or photographs with relatives as they could be construed as P2P again, and could EBay be considered a business????
The details as I received them:
Quote
It is a very substantially different document to the original RT T&Cs and now stipulates steaming video and P2P as being serious Network Abuse, which WILL result in Clode...sorry FatCat taking action against the account holder and severely limiting the bandwidth used on that account to be equal to that of the lowest bandwidth user on the entire network....!!!
They have also stated that all use of their service is for purely personal use and if they identify or even suspect any user may be utilising their connection for business purposes then they now class that as a material breach of contract and WILL terminate the line immediately!!!!
End of Quote
Take care friends, READ THE TERMS AND CONDITIONS CAREFULLY BEFORE YOU SIGN!
