I can't believe Clode's response as quoted on here. Of course they are jointly liable. What a difference to my experience with Barclaycard, when I couldn't get a response from a retailer that had taken an order from me paid with my barclaycard visa. Barclaycard were straight on the case for me and soon got hold of the retailer and sorted it all out.

I'm keeping my recorded delivery letter fairly succinct, along the lines of:

    Dear Sir or Madam,

By a contract made in November 2006, Redten Communications in the course of their business agreed to supply a free PC and up to 8Mb unlimited broadband for a period of three years in consideration for the sum of £19.99 payable monthly.

It was a condition of the contract that the consideration was to be paid by means of a loan agreement with Clode Retail Finance Ltd which is a Credit Agreement regulated by the Consumer Credit Act 1974.

Clause 12.12 of the Redten Communications Ltd. contract states:

12.12 Should we increase the Charges or make any Contract
modification, which is likely to be of material detriment to
you we shall provide you with 14 days written notice and
the increase or modification will take effect from the end
of that period. If this occurs you may be entitled to
terminate your Contract by giving us written notice
detailing the proposed modification at any time on
providing us with 10 working days notice, such notice to
expire before the price increase or detrimental contractual
    modification takes effect.

Broadband service was terminated without any advance notification on 10 March 2008.

Broadband service resumed on 19 March 2008 with substituted provider with a 5GB monthly download limit.

Redten Communications Ltd. is therefore in breach of clause 12.12 of the said contract. The 5GB monthly download limit imposed being a material detriment to myself. Clode Retail Finance Ltd. is jointly liable under the provisions of the Consumer Credit Act 1974.

I therefore wish to terminate my contract with Redten Communications Ltd. without any form of penalty and await your response within 14 days.

cc. Nicola Dobson, Ops Control & HR Manager, Clode Retail Finance Ltd.,

mine a little more lengthy than that, I have detailed all the problems I have had, quoted their own FUP as well as Sales of Goods Act.
I have also stated that I wish to have my contract terminated with no penalty or detrimant to my credit rating and to be provided with my MAC within 30 days of the initial disconnection, i.e. before 11/04.

oh, and I've also added a print of their website which still states a FREE PC and is dated 2006.
  • New High Sheriff for Bedfordshire

    Nazir Jessa

    Former businessman 'pricked' into action

A retired businessman was officially named High Sheriff of Bedfordshire by Her Majesty the Queen last week, when she 'pricked' him into action.

Nazir Jessa, 66, former chairman of Luton-based firm Watford Electronics, was nominated for the role in November, and on Wednesday his investiture ceremony took place at Buckingham Palace.

In a tradition dating back to the reign of Queen Victoria, the Queen used a silver bodkin to !!!!! the name of each new High Sheriff for the whole of England and Wales, which had been written on parchment.

The role of High Sheriff used to involve many of the duties now carried out by the Inland Revenue, magistrates, local authorities and coroners.

Today, however, it is a mainly ceremonial position, but they are still expected to attend to the needs of High Court circuit judges presiding over the county's crown courts, a remnant of their duties in times gone by, when they had to raise a posse to accompany the judges.

Mr Jessa, who lives in Watford, was born in Tanzania, and worked as an optician before founding Watford Electronics.

In 1994 he founded the Hertfordshire Ethnic Minority Business Network, and three years ago he launched Computers for Africa, collecting second-hand PCs from businesses for redistribution to schools in Tanzania.

@mac - ill wager there is something in the t&c that lets them transfer private details to this end. Im only speculating however, but I bet there is.

Hi bobby_fudge, yes I started to put in the stuff about the BT message, getting Mac code, signing up for AOL broadband, etc etc....but my fingers hurt with RA. There's time to put all that in when we go to court - and I WILL take them to Court if this is not resolved satisfactorily.

I'm sending the letter to Redten at both Luton and Docklands addresses, and have copied Clode as they ARE jointly responsible. I have also faxed it to Clode on 0844 844 2500, as a fax is an acceptable hard copy means of communication for the Court.
