Ebay Help

Hi

I need some help - here goes a quick run down of my situation

-Sold a kids costume on Ebay
-Person bought it, paid for it via paypal and I posted it second class
-3 weeks later the buyer contacts me and said it hasn’t arrived.
- opens resolution centre dispute.
-a further 2 weeks pass and it is returned to me via royal mail, stating that the buyer didn’t collect it from the post office.
-I tell the buyer she has to pay the postage again to which she declines and ebay step in
-Ebay find the case in her favour and refund her the money
-I appeal which is turned down
-My account is now suspended because I wont pay my ebay fees

My issues
Although I didn’t prove that I originally posted it, royal mail assigned a reference number to the parcel when it was sitting in the local sorting office for her to collect so in a roundabout way I proved that I posted it and she failed to collect. I don’t see this as my fault and I can’t see why Ebay found in favour of the buyer as she failed to collect it.

I have tried emailing ebay and I just get standard response back, however I did have a couple of personal ones back - one stating that the reason they found in her favour was because the sorting office was too far from her home address!!!

I am now stuck with a kids costume which was hard to sell in the first place during a peak time (Halloween) and a suspended ebay account all because she didn’t collect it from the post office.

I don’t want the costume and I don’t want the hassle of selling it again.

    Ebay and paypal are two companys that very rarley budge, on my expiriance i would pay the ebay fees, because eventually they will ban you and its possible your bank account will be barred from paypal ( due to impending paypal limitations)

    Pay up - move on and forget.

  • it is unfortunate for you but i dont think you have a leg to stand on im afraid- i am sure it is a condition of paypal that you send the package trackable- ie recorded or special delivery. I know it probably wasnt worth it due to the cost of the item but unless you can prove delivery then paypal will always find in the buyers favour. It is really worth getting your account suspended over the small amount of fees that are involved when in effect- you didnt follow the correct proceedure? if i was you i would learn a valuable lesson and pay it. Even if your buyer had received it- they could still have claimed they hadn't and you would be in the same position- always cover yourself by sending recorded.
  • Unfortunately Ebay and Paypals customer service is at best woeful, inadequate and shocking and at worst - non existent. The only thing they care about is their fees. You need to get your head around that fact.

    The biggest mistake you made was not getting proof of postage or sending it recorded. You won't get anywhere with them.
    If you want to continue selling on there, like the other poster said, you need to pay your fees, forget about it and move on. Put the damn costume in the cupboard until next year and try and learn a bit about how Ebay works - there is a good board on here and on Google you will find loads of info.

    Thats right, the only thing that counts is proof of postage, without that its an automatic refund.
    Ebay is now a buyers market and not much stops a refund, even if she got the costume with tracked evidence, they can simply say item was not as described and it gets refunded.
    With ebay you now have to accept that anything you sell could come back to you. Despite this pitfall it's still not all bad though, the vast majority of buyers are genuine, but there are a growing number who now know how to play the system. I blame the fact buyers know they can't get a neg feedback.

  • i still dont think paypal will play ball- if its not a reference number they can enter into royal mails online tracker they will say it is invalid and i think it is proof of delivery- not postage- they are very pedantic. your buyer might not have even realised it was at the sorting office- and on the other side it is harsh they have to pay two lots of postage- you could offer to send it again so you dont lose out the full amount? or resell to recoup your losses. Or try with paypal but they will most likely say you did not follow their terms and conditions so won't look at mitigating circumstances.

    Forget all about proof of postage. In the event of a Paypal non received claim, the only evidence that you can provide to win the claim is online viewable proof of delivery.
    Just because you received the package back with a reference number on it doesn't mean that your buyer had any idea it was in the sorting office waiting for them to collect.
    NOt all posties can be bothered leaving a "We tried to deliver a package" card, and they may have simply knocked, then taken the item back to the office.

    There were a lot of stories on the ebay boards mentioning this happening over the Christmas period, which may have been caused by the increase in temporary postmen employeed over that period.

    Actualy sorry I meant proof of delivery, not proof of postage, got them mixed up.

    The paypal rules state that you must show tracking to show proof of delivery.

    As you do not have this, you lost the claim.

    You could try PHONING ebay to contest it, rather than emailing it, and hope that you get someone with some common sense at the end of the phone line.
