    Although we may not always see eye to eye, I honestly think this thread is made all the better by your (and Constantines) posts, to be honest, Its a shame there arent a few more Tesco employees willing to post on here in the way that you do, we have been told a number of times that KK reads this thread, shame he cant find the time to post and say hi once in a while!

    To read loads of posts all on one side of an arguement/discussion would get very boring, at least you guys offer that alternative point of view!

  • Anyhow, bought 2, went to CS and told them I had bee overchared, CS Woman went to have a look at the shelf (I waited at CS) and waited and waited Eventually she came back and said she couldn't see any box, only the SEL of £4.98. I told her I would go with her and show her. We got to the shelf where the Umbrellas were before, but guess what? the boxes had been removed and Umbrellas were scattered all around the shelf. It was pretty obvious that she or another Tesco Staff member had deliberately removed all the boxes. I told her this too. Anyhow, I said I wanted a full refund (and gave umbrellas back, told them I would do Xmas Shopping elsewhere)
    Exactly the point made in recent days about 'dirty tricks' - where during the time it takes to checkout, offending misprices have been corrected. This is particularly likely in smaller stores and/or where someone has been recognised as an r&r shopper.

    To me this IS tantamount to fraudulent behaviour by Tesco stores that do this or that turn a blind eye to this practice, and they are on VERY thin ice IMHO. As I have said before, there should be strict procedures for the disposal of price indicators. (Any MSers have feedback regarding the law on this?)

    This means WAR!

  • I was a witness to an r&r today where the CS assistant said to the SA (who was still clutching the offending SEL in his hand) "You've go to throw that away!"

    The SA was a bit deaf I think and said "What?" She said (looking harassed from Saturday shoppers) .... just get rid of it .. you've got to throw it away!!

    Yeh....This has become one of the standard rules after submitting your "I think I've been overcharged"

    You must accompany the CS assistant to the offending SEL

    otherwise, it often "isnt there"

    The law relating to this is clear, if this occurs a deception has taken place, ie a wilfull effort has been made to deceive the customer and to obtain a pecunary advantage on behalf of the vendor, this is a criminal offence and not a civil offence! In such circumstance if you wish to pursue you should make your intentions known to the store manager and inform him or her you require cctv footage to be secured in order to substantiate your allegation and that you will be making a request for the footage under dpa, having informed the store they are LEGALLY bound to ensure all steps are taken to preserve any footage for later examination.

    It would be wise to get acknowledgement of your request in writing for the store and or have a witness to the request who is prepared to sign an affidavit to that effect at a later stage. Any reasonable costs incurred by your witness can be claimed back at a later stage

    I am intrigued how Tesco can reasonably( ;) )take this line of arguement. Anyone who shops regularly at Tescos, and keeps even a vague eye on the prices would see the prices go up and down, then back up again, then back down again etc etc.
    So In your example:-
    Week 1, store 1, you see an item for £x but are charged £x+£2.50 you ask for a refund under their price promise
    Week 2, store 2, you see the same item clearly advertised at £x. You are charged £x + £2.50 ( I assume).
    Store 2 refuse R&R because of events at store 1

    Points to note
    1)If Tesco store 2 know you had a refund on the item from store 1 because it was displayed at £x, but illegally charged at £x+£2.50 why did they not make sure they were not breaking the law themselves ? Why did they knowingly have a sel for £x, when they clearly knew it was £x +£2.50
    2)Take the current games price fiasco as an example. The price can vary from one day to the next.
    I am confused, splinter cell on PS2 was scanning at 24.77 in my local store yesterday but everyone seems to be getting it to scan at 29.83, has anyone else scanned it since Thursday (when I got my copy and it was 29.99)

    I make that 3 (THREE) prices in a few days time frame!!
    So just because you were charged £x+£2.50 last week at store 1 does not guarentee you would be charged that again.......sometime Tesco actually manage to get their scanning and sels to match ;)

    The Minority report/I robot dvd has been overcharging for WEEKS (£9.97/£22.xx) They have now, eventually got their act together and it is now scanning at the display price of £9.97. Same with the filofaxes......the list is endless.

    If Store won't budge, use it as a learning experience - don't use credit OR club card when on an R&R mission.

    Sadly, we've also had this problem where the staff have moved in after recognising an r&r regular and 'cleaned up' before it even gets to the CS stage. Even accompanying the CS doesn't help in that situation.

    Well I ended up with over £160 worth of trade in value - so i`m sure if you do enough you will get there - yeah. One GAME (I wont be going back to) refused to let me trade in two copies of the same game at the same time. So I traded in one, walked out the store, waited a minute and then went back in. He then accepted the trade in :confused: plonker.

    But my (now regular) GAME accepted three copies in one go - so go figure !

    And the prices are set by supply and demand in each store - so the more you trade inof one game, the lower the price gets.
