FOR THOSE WHO GOT AN XBOX SILL AWAITING R&RCan't see any chance of the stores r&r'ing it now ... but never say never ....It is a criminal offence for traders to give a misleading price indication about goods or services. That applies in whatever way the price indication is given, whether written in a notice or leaflet or given verbally. For example, you may see a shelf edge price ticket showing £5 for the item, then you are charged £5.10 at the checkout. Another misleading price indication may be a price indicated on a leaflet, but you are charged at a higher price in the store. ..."
I'm thinking of taking mine to Trading Standards (or Consumer Direct) as they're now called ...
Two Key points... The advertisements saying save £19.97 did encourage me to buy the bundle pack ... it was only later I worked it out that the 'advertised savings' were false and Trading Standards should be informed of the criminal offence etc.
I also have numerous pictures of the offending posters, SEL's and the small display pack etc.
Trading Standards have a lot of good info in particular:

As per their not honouring their Refund Policy, Kevin Kellys thinking is that this was NOT an overcharge ... (funny how they offer you the £2 back tho!)
They say that as this was not an overcharge, you are not entitled to a refund and retain etc ... This is arguably a breach of contract as the sums clearly don't add up ...
As Kevin Kelly won't seem to budge (although I must admit I did find his irritable manner amusing) ... He'd be crap at the bit on Countdown actually, his maths is atrocious ... come to think of it, hes not that eloquent with his words either..... but seriously ... :rotfl:
My thoughts are the best way to do this, could be to write a letter to Sir Terry Leahy (MD), asking for a written explanation re this matter ...
It may be also worth stating that it is your likely intention to take this to County Court (Small Claims) if this is not resolved.

I'm not saying this is THE way to do it, just my thoughts, it'd be good to keep records of your conversations / letters etc (and send them recorded delivery too!). I'm not sure about the legitimacy of it but if you had a tape of any conversations with Kevin, I bet there'd be some howlers on it too ...)

Right I now have 5 Xbox 360 Splinter Cell's, they don't play in my CD Player, I keep getting a 'NO DISC' error message. Am I looking at an expensive but thin set of coasters ?
All of them are unsealed in that I bought an empty plastic box and was then given a CD and a small magazine. As they are 'unsealed' can I take them back ?
Are they covered by the 28 day policy or are they excluded ?
My receipts just say Xbox game, so how do Tesco know what they sold me ?0 -

Im still awaiting an R&R on mine and I called Consumer Direct yesterday and filed a complaint.
However the guy on the end of the line wasnt very helpful, I told him the situation and he kept saying that I paid the advertised price and that Tesco didnt have to refund me the product. They also said that Tesco dont have to obey there policy if they dont want to. Which is utter rubbish, which is what I told him and it probably didnt help.
In my case CS offered to refund pro evo in the bundle and I refused saying I didnt buy the game and xbox seperately, I bought them as a single item and I should be refunded the lot. By offering me a refund on the game they have admitted there guilt. I told this to the guy at Consumer Direct and he still sided with Tescos.
Even with this I still wanted Trading Standards to investigate so I filed a complaint.

I am also going to go down this route as my local trading standards office have advised me this is a cast iron case of over charging and misrepresentation.
The mistake is Tesco's, we have paid the price in good faith attracted by the product marketing and quoted savings. For their part Tesco have broken the law and do not honour their promise to customers. Remember even forgetting the Tesco customer promise you still have statutory rights and Tesco should be brought to account!
Reading this thread it is also apparent they are happy to misled customers further by just changing SELs simply in a vain bid to backtrack from the errors they have made.
I also have photographic evidence of the displays and SELs, I even have the receipt from a Pro Evo game that I purchased separately to prove the price of the game as being £37....
The bottom line is that each of these Xbox R&R's are completely legitimate but by taking the "get stuffed stance" Tesco is hoping you will all go away, enjoy your new Xbox and simply accept the price you paid - but why should you?
If you feel so strongly about this and believe like many that Tesco are guilty of misleading their customers (and happy to overcharge when the less savvy shoppers do not realise) then you should make you feelings known to Tesco and contact trading standards.
Tesco may be a massive, powerful organisation and the number of customers affected here may be low if you do not fight back it will happen again to other people.... Also condier for a moment how many other people have purchased these Xbox bundles over the past few days ready for Xmas? - are we just the tip of the iceberg and are they totally oblivious to this ? (Tesco clearly hope so)/
Just remember people power does count in cases like this and in Tesco's own words...

Your statutory rights are not affected. If the games are faulty, you can take them back.In a rut? Can't get out? Don't know why?
