I have just been accused of fraud and banned from a store, they claim to have cctv footage of this (placing mispriced SELs which is a complete lie) which they refused to show me as obviously they didnt have it they also threatened to call the police in an attempt to make sure i left the store, but backed down when i insisted that they did due to the nature of the allegations i think i have managed to record some of the accustations being made. The store manager at one point said to me "were you in XXXXXX store yesterday" when i replied "no" (which i wasnt) he then replied "oh really of course you werent"

i was on my lunch break so had to eventually leave the store and accept a refund and return the product, head office even refused to RNR due to the allegations made against me

will no doubt give a more long winded version of events later but just wondered if anyone had any idea on my next step?

    I would be minded to call their bluff. State that you have taken legal advice. Say that (1) you want it in writing what their allegations are;
    (2) Pursuant to the Freedom of Information Act and your personal rights you are entitled to see all video footage of yourself (you should offer to pay the reasonable fees of copying the CCTV tape for your benefit); (3) by calling you dishonest they are slandering you (if they write it it is libel) and you want damages for defamation; (4) unless they deal with this satisfactorily you will bring a claim in the Small Claims Court, seek Trading Standards and inform Which Magazine and Watchdog and other media.

FOR THOSE WHO GOT AN XBOX SILL AWAITING R&R
Can't see any chance of the stores r&r'ing it now ... but never say never ....

    ....

Well done to all of you for taking this further, so much rubbish gets posted on here about taking Tesco to court etc and nobody ever goes further with their complain, I am sure it is for reason that Tesco HO have started to turn people away and ignore their won company policy.

Right I now have 5 Xbox 360 Splinter Cell's, they don't play in my CD Player, I keep getting a 'NO DISC' error message. Am I looking at an expensive but thin set of coasters ?

All of them are unsealed in that I bought an empty plastic box and was then given a CD and a small magazine. As they are 'unsealed' can I take them back ?
Are they covered by the 28 day policy or are they excluded ?

My receipts just say Xbox game, so how do Tesco know what they sold me ?

Might help if you put the games into an Xbox 360 instead of a CD Player!

LOL why would you want five copys anyway!
  • Dance 2007 is still working. I popped my R&R cherry with it today!

CS looked like they would give me a bad time, but no, they didn't even offer the difference- straight for the full refund. After checking the SEL of course.

They looked at me like I was a serial offender with many notches on my belt, probably weighing up whether or not to try it on. How little they knew, that I was a true virgin. Just a big thankyou to the CS for making my first time easy and pain free. ;):D
...and then the window licker said to me...

Surely R&R is Tesco's policy and if it causing them such a problem upholding it then they should change it, other supermarkets don't seem to have these problems. How hard can it be to programme a new item into the til system with the correct price.

I can't believe CSA's are behaving in this way it's not as though it gets taken out of their pay.
Of course other supermarkets have these problems, but none has or had such a relaxed attitude for refunds!

We have had this debate numerous times before however indirectly it does come out of their pay........in the form of the share price, the share dividends and profit sharing.....
