I didnt know my licence was revoked until, december 2011!!!! i would not intentionally do that by any means.

As i said i take full responsibility for forgeting to send it back but i would in no way intentionally defraud :-(. I didnt know until i was told by the police, i have read several stories of people not knowing their licenses were revoked and still applied for insurance unknowingly.

I will take the stick for not submitting the license in a timely fashion but not knowingly commiting fraud. I am now finding this more distressing..

    A Timely fashion????

So why didnt you send you license back to get the points put on in 2006/7? Did you just think they would forget about it?

Did you not receive anything from DVLA/Police informing you your license would be revoked?

I have seen and heard about more and more people not being informed about expired licences these days, surely it can't be down to incompetence at the DVLA, I tried to fight a case where they lost my logbook, and no they didn't back down and I got fined £215 for standing my ground, I like most people don't have the time to appeal, poxy magistrates.

I think it highly likely the DVLA lost your letter or forgot to post it, like so many official organisations they all went to pot under New Labour, though they are very good at making mistakes that cost you money.
  • As it was an oversight to send your licence in I assume you have also informed your insurer of these points?

    Or is that another oversight........

My view is Welcome are doing us a favour by keeping the OP off the road.

    Yes
Must be great if you've never missed sending a letter anywhere.
But as for the rest of us mortals down here........

Thanks for your kind words, I know I can expect these harsh comments from others but i feel awful, very depressed. Will take whats coming to me as in paying the full amount to the fianance company and will make sure i complete and send any forms back that i should in future. I feel bad for being so foolish and not making sure everything was ok :-(.

Thankfully the finance have said they will not auction the car and this does happen with people.

Unless you have a glowing halo floating round your bonce, don't worry about it. We're all human. At least you found all this out now instead of further down the line or after a nasty accident or something! Good luck getting it all sorted.

But if she has just done this she will have declared this to her insurers.

    Maybe the OP could confirm.

OP - Are your insurer aware of your conviction and points?

Who cares, it's her business, not ours.

I'd just like to reiterate that the Fraud Act 2006 defines all offences of fraud as WITH INTENTION, which MUST BE PROVED. So I wouldn't worry about that bit. The DVLA would have to prove they sent the letter to you to say your licence was revoked, which they won't be able to because they never sent it no doubt.

I remember reading on another thread that someone was having difficulty getting car finance without a licence (there was some legitimate reason why they wanted to do so). Thus my initial thought was that this was the reason the finance house took the car back, as its likely to be a condition of finance that you have a licence. Though I suppose this is by the by now.
