Finance company have taken my car from pound and I need to know where I legally stand.

Hi guys I need some help with my car being taken by welcome finance even though i have not defaulted on any payments with them.

On the 24th December 2010, my car was seized, by the police on a random check, they asked me if i had a licence i explained that i have held a licence for 10 years. They advised me shockingly that my licence had been revoked in 2008! I was obviously shocked and explained that i have always insured my car have rented cars here and abroad and had previously been stopped with a friend whose car was untaxed on the way to the garage for an mot, as she did not hold a full licence she was able to comtinue driving with me beside her??? However my car was seized. I was told it could be collected with someone who has fully comprehensive insurance. whenattending the pound that evening i was told that the person collectiong the vehicle must be insured to drive my paticular car? i Then proceeded to look for insurance for my relative full or temp, this proved difficult as you have to be the registered keeper or temp insurance does not allow u to take the car out of a pound.

    The obvious questions would be:

Why was it impounded (and by whom)?
How long was it impounded before they took it?
Are you up to date with payments to the finance company?
  • I explained this to the pound who said that there are companies that insure i will just have to find one, when asking for companies they failed to tell me. On the 29th Dec i went to borehamwood where i thought i could get a new licence on a same day service as told, i was told to send my application by recorded delivery to the manager with a note explaining my dilemma, I did this immediately.
I then rang the pound to explain I had done this, and was told that the past 4 days were free due to the xmas period and the amount due is £170. (one days storage £20 and release fee £150). I also asked about them scrapping the car after 7 days i was told they would take into account the bank holidays and have a collection date for 11th January. I still continued to look for insurance for a relative but to no avail. on 30th although presumptious I rang DVLA to check whether it had been recieved it had not. The following days were the bank holiday weekend so I could not check. On Tuesday 4th January 2011 i rang DVLA who advised that my licence has been reinstated and I am legal to drive, I immediately rang the pound and advised them of this i explained that i do not have the licence in hand but if they check the police national computer they will see i have a licence. I asked if it was ok to bring my passport driving licence and borth certificate as proof of identitiy along with the V5 and insurance they said yes. When i got there they advised that the computer did not show my licence was reinstated and i could not take the car however the finance company werfe booked to collect my car in the morning.
  • Sorry

Car impounded by the police as licence revoked
Pound emailed finance company to collect car
I am not behind on any payments
Finance comapny advised car has gone to wimbledon to auction house
  • My licence was posted by DVLA today.... the finance company ....welcome finance want full payment for the car plus £370 pound release fee and possible charges for collecting the car from the pound. In reality it has taken 3 working days to get a new licence is this fair?

If I understand it then, you were driving without a licence or insurance and have not kept up with the payments?

    Is the car worth much?

I don't understand how your licence could have been revoked without you knowing? What reason did they give for it being revoked?

One of the conditions of the finance will be that the car is comprehensively insured. Is this the reason they hve given for the repossession?
