I'm sure under the sale of goods act theres no contract until it's despatched as it's just an invitation to treat, if your items showing despatched - you might have a leg to stand on, if not the you don't!! I hope the op manages to get this though

    one could be forgiven for thinking the balloon trip was a proper price due to sudden lack of demand and/or cancellations.

    I mus admit it was my first thought, but I can assure you that commercial operators can not offer the item for £36 without making a big loss.

    Secondly the event at the weekend was not in any way a normal flight.
    Going to 20,000 feet and using oxygen is absolutely not normal and contains risks.
    The normal flights are very safe indeed, in fact safer than driving your car to the launch site.

    very can blame it on me yea right.. after after all they are the stupit idoits that made the mistake and should be held accountable for there own actions if i had not brought forum up it they whould have been sold unoticed

    Yes but it doesn't form a contract.
    You will get your money back.
    I have been checking and this type of contract has not been proved wrong in courts and it's been around for about 10 years.

    I agree it doesnt form a contract, but as I never received a confirmation email I assumed my order had not gone through, yet they have debited my account.

    This is unfair practice imo, if at point of sale they had no intention to honour the sale they should not have deibited my account.

    It looks to me as if the system is automatic.
    They may not have discovered the mistake when your sale went through but they aren't legally bound by it.

    I don't think they are gonna give and I don't think anyone is going to take this to court either.
  • I, like many, chanced this this morning - under the almost certain knowledge that it wouldn't pay off but it was worth a punt.

    The Paris trip was clearly a misprice. It was too cheap for even one person.

    I can't believe people would get upset about not getting such an obvious glitch. It really is a case of 'win some, lose some'.

    I think it was discussed at length, the 'deprivation of bargain' (?) angle before a couple of times to my knowledge. ONce, with B&Q which did result in a order fulfillment (water butt) and about a ridiculously cheap huge flatscreen tv from pixmania that did not result in order fulfillment. It may have been over on HDUK that it went into huge detail about the law when money has been taken as opposed to just an order confirmation. Perhaps someone else here remembers and could pop up a link.

    I would have been over the moon to receive the Paris trip as a present to my boyfriend on valentines day, as i could never afford it in reality, but am not surprised about it being bounced.

    However, i currently have about £100 worth of sale items in my basket (mainly bedding and curtains with only smallish discounts - not the x factor stuff!) and I most definitely won't be ordering now as, like others have said, if this is indicative of the company performance and attitude, then I will chance the shops for my new bedroom makeover linen!
