Right, so:
1) you are aware aren't you that the ASA has no power of punitive sanction? i.e. even if they investigate and if they find in your favour, they can't "make" the Indie give you a DVD.
2) How do you propose to get over the "while stocks last" part of the Terms?
3) The obvious defence for the Indie, even if they took this seriously ("seeking legal advise"(sic) - oh yeah, I think not) would be to say that MSE and the other freebie sites hijacked their promotion and ruined it. Perhaps they'll suggest that the MSE and other site owners might want to pay?
Perhaps you should have made a polite and detailed request to the Indie first, since you are a reader, rather than instantly throwing threats and complaints around?

Forest Gumps mum was right when she said life is like a box of chocolates..... If your early you get to pick and if your last .. well sometimes stocks run out and if its in the terms and conditions "while stock lasts" theres not much you can do about it.

Well we've haven't had any of the orders cancelled for a very long engagement, the fact that there was one remaining DVD available to order en mass is a good sign and they probabily need to order a lot in if they honour their offer. I wouldn't jump up and down yet. I expect any phone calls about not honouring the offer could refer to the DVD's like Amelie that ran out (ie you wont get them). So wait and see its early daysMoney, Money, Money ..... Banks/Casinos/Bookies give me all you money its a poor mans world....0

It's only a free DVD. People are dying through hunger all over the world. So they have ran out, big deal. I assume if you bought the papers you normally buy them as the codes were in this forum so you have not "lost" anything. I too could only get "A Very Long Engagement" if I don't get it no loss. In the television advert they said a free DVD for every reader so my question did Play.com have over 300000 to give away???:money:
The answer is no so people like me who did buy the newspaper have been misled. This is like the time out offer, but were i did buy the newspaper and magazine I also read about it on here, but I am in fact the reader that hasnt recieved my fair DVD or CD.0 -
