• Basically making sure it was my account, along with a few other questions. I made sure to let them know though about how BIY are being run. I'd sent them a copy of my order page before hand and I'd also posted a picture of my online "help" page.
They're not that stupid to think that it was all a set up by a competitor. I think they were trying to cover themselves a bit, didn't want to be caught up in the middle of a sting ( by us ) Unfortunately the sting was going the other way.

The TP page has been battered now with the truth :T

Although I have (finally) had my refund, I'm still following this (as others are doing) in order to help those still out of pocket with this bunch...

Probably counts as old news, but I had an answer this morning from my email to Southend Trading Standards which confirms they are investigating TOBC, in addition to the likelihood that they are still trading... Probably worth contacting (as they suggest) Consumer Direct too. I've copied/pasted the meat of it below:

If anything else, at least it gives everyone documentary proof that this shower is under extensive trading standards investigation. Try defending your actions now, Damon :D ...

".....Unfortunately Southend Trading Standards no longer offer assistance in civil law disputes such as yours and if you would like further advice on your rights and taking your case forward you should contact Consumer Direct either by email at www.consumerdirect.gov.uk or by phone on 08454 040506. Please let them have your home address and the address of the trader, plus the method of payment as certain cards give you additional protection, eg chargeback, or Consumer Credit Act.
Consumer Direct also add the details to a national database of complaints which all Trading Standards offices can access. This allows us to build up a national picture of problem traders.
As a result of previous notifications, I can confirm that Southend Trading Standards are currently looking into the trading practices of this company and are in discussion with colleagues from other outside agencies regarding possible breaches of criminal law that fall under Trading Standards’ remit. If further information is required from you, either ourselves or our colleagues will contact you.
In response to your query as to whether the company is still trading, we are unable to confirm this is still the case but the premises were observed to be open and assumed to be still trading on 1 March 2012."

Kind Regards

• I got something back from TS along the same lines, mailed them back to say im more than willing to give anymore information if required.

Just do not want others to fall into the trap.

Something cant be right at Damon towers as the bad press is still on his forum and its not been remvoed. Anything in the past has been deleted before 9am and this was posted at 5pm yesterday!
• hmmm, his standards are slipping ! :p

All they need to do now is change the "about us" page on their website, just read through it again about how great they are ,the biggest in there field etc averything is the complete opposite to what they are suggesting.

The highlight being,"But don't take our word for it.... Read the independent reviews written about us on Trustpilot."
