1% over payments on cc 3.5/100 (March 2014)0 -
About 6 years ago I got into quite a bit of debt with LloydsTSB after taking out a loan that I couldn't afford. It was about this time that I started getting default charges which I have now decided to try and claim back. I agreed a refinance loan with LloydsTSB by which my payments were spread out over a longer term.
My current account is now with Halifax but I was told I had to keep my Lloyds account open and make a standing order payment into it every month so they could take the loan payment from that. I have done this ever since and never missed a payment but I have about 3 years left on it.
My concern now is that if I try to reclaim charges they could demand settlement of that loan straight away. Can they do this or do I have a separate binding agreement with the loan that says they cant ask for an early settlement so long as I've kept up to date with the payments? Any advice appreciated.0 -
Hi
I'm seriously considering reclaiming my bank charges but need to be re-assured about one thing first.
My current account is with the Bank of Scotland but I also arranged my mortgage through them, with the Halifax (one and the same bank?). If I reclaim charges from the Bank of Scotland is there any risk of them closing my Halifax mortgage account? Although I manage to pay my mortgage payments every month without too much of a problem, I know that I am no longer earning enough to qualify for the mortgage amount I have borrowed. So, if they close my mortgage account I wouldn't be able to raise sufficient funds anywhere else. Can anyone advise, please?
thanks

No I am right. Read what I actually posted. I just stated a fact - the ombudsman said you cannot close down account just because someone claimed back their fees.0 -
First of all thnks to the help from this site (Nationwide are agreeing to a payment plan on my morgage).
I was in Nationwide on Saturday morning and asked the nice lady on the help desk if Nationwide abided by the Banking code
yes she said in a worried tone, so I asked if I took legal action to reclaim my (unfair) bank charges would they close my account. She checked on the system
not knowing who I was and i quote "Yes as we consider the relationship has broken down". When I queried this the reply was "It wont be because you reclaimed your charges, its because the relationship has broken down". So there you have it folks. Perhaps when they have so few customers they will realise their mistake, unless the authorities stop them doing this.
Waiting for DPA reply from Capital One.0 -

This is an extract of what the Ombudsman said:
"He should not be prevented from bringing a legitimate complaint by the threat of having his account closed; nor do I consider it fair or reasonable of Alliance & Leicester to respond to his complaint about charges by closing the account. Alliance & Leicester appears to me to have used the closure of the account as a retaliatory or punitive measure."
However, the account remained closed, so banks WILL still close accounts although at the moment you can as a last step make a complaint to the Ombudsman and you may get compensation for the banks behaviour.0
