Could someone confirm where we stand on this - I've been delivered something I didn't order & don't want, does that mean I have a right to ask Thorntons to collect at their expense?

I know a lot of people will receive these & keep them cos it's Xmas & who has time for the hassle of calling up & arranging pick-up / returning them? I think that's what they're banking on. MSE'ers receiving this sub-standard selection have been had - tricked into handing over around £30 we wouldn't otherwise have spent. The only effective way to respond is to make this cost them - so, personally, I want uplift, at their expense.

What are our rights here - & how long do we have to respond after delivery - can we wait a few days (get Xmas over!) before calling them?
Someone posted a link to the DSRs a few pages back.

Yes they do have to bear the cost of return because the goods are substitutes. The regulations also say they they can't wait until receiving the goods back before they process your refund.

They have agreed to send a courier to collect mine. They said it would be in January but were unable to give a specific date. I'm not sure how they expect to get them back if they don't tell me when as I'll be back at work by then.

Well i have been totally surprised by thorntons on a good note!! I got the winter wonderland hamper yesterday and it was only ordered 2 days prior to that so for £2 next day delivery greta as i want expecting a smooth transaction ...BUT... delivered an open box by an old boy who said i think its marks's stuff!?!
opened up box and 2 figures santa and snowman completed smashed brazils box flattened to a card and bags hanging out no fudge or mints but i got winter continental small box, and melts.
The melts box was battered and the truffle baubles 2 were caved in and all the same flavour instead of 3 different ones, another box (was ripped no good for presents so i had to keep sigh!)

anyhow i rang thornton yesterday and she oredered me new snowman santa and reindeer ( he was whole but chipps all in box where hed been bashed about) she said i could keep damaged ones and use for hot chocolate and i have stinking stinking cold!!
But also as i said i had no mints or fudge i was given them and another box of melts and brazils.

also thrown in were 3 white choc sachets to compensate for the powder of the white champagne baubles that were on bits.

BUT THIS IS THE GOOD THING just took delivery of replacements an half an hour ago!! all figures were wrapped in bubble wrap and inside indibidual cardboard boxes and INTACT!! Also boxes were clean not smeared with chipped of choc.

so i want to say Thorntons have been first rate for me and i hope this ,eams i'm not the exeption! If you have damaged figures ring up and complain as it should have been like this in the first place! the figures i received were disguisting and what you would expect to pay £1 for in poundland as seconds amnd as they are now on sale for 4 for £10 its not gonna be out of their pocket much 3 figures for just over the prcie of one (if they were "worth" £6.49 in the first place - hardly)

So when you get a despatch email (or in my case) expect the box the next day!!

Some people seem to have been taking the view that we should all be deeply grateful for whatever scraps Thorntons decieded to throw in our direction because they needn't have honoured the supposed 'glitch'. Do they not realise that Thorntons are making money out of selling such rubbish.

It is very unfair on people like thegreenroom who need a gift for their family and now don't have time to source anything else :(

I agree - I'm genuinely amazed that on a money saving site like this one there are so many people who are prepared to accept what Thorntons have done here.

It wasn't a glitch - it was a cynical marketing exercise to allow them to get rid of surplus stock that nobody wanted.

To anyone who doesn't want what they've received (if it isn't what they ordered) - claim a refund by phone or email and insist that Thorntons arrange for collection or pay the return carriage. You have the right to that.
  • well i sat here getting more and more angry so phoned them back up and told them they can come and collect them as i didnt order them and i didnt want them and they were unsuitable for my children as the majority was toffee, the call center worker said oh,are you one of those that ordered the winter wonderland hamper for £30, i said i am and im not happy with the substitute so you can come and collect he said your getting £80 worth of chocolate for £30,so i told him the majority was toffee and unsuitable,he then went to speak to his manager and came back to say i could have something else to make up the price but it had to be the original selling price of £40 so i went for the limited edition festive collecton, still not great but better

  • Here's the e-mail I've sent them through the 'Get in Touch' link on their site:

' I ordered a Winter Wonderland hamper, but received an e-mail message saying 'Unfortunately we've completely sold out of the Winter Wonderland Hamper and so We have substituted your original order with two of our best-selling, delicious Chocoholic Hampers'.

Unfortunately, what has been sent is not what I ordered, nor anything like an adequate substitute. I would be grateful if you would pick up the 'Chocoholic Hampers' and refund my payment. Please inform me of the pick-up date and time as I will need to be sure someone is in. Thank you. '

Anyone not happy with their £30 worth should do the same - they need to know they can't take customers for idiots. And that if they try to it will cost them.
  • I have just received a replacement santa & snowman for the smashed ones after letting Thornton's know yesterday that they arrived smashed(Only one sachet of white hot choc for me though, with an apology card)!

My cash back tracked and apart from a few minor substitutes my winter wonderland was virtually as advertised, my cashback even tracked at £3.89, so I was one of the very lucky ones, enjoying great customer service!
