Personally I would not care about whose responsibility it is, at the end of the day a confused buyer purchasing the wrong item means hassle and time wasted dealing with it.
...i'd prefer a pragmatic approach and give as much info as possible to avoid any hassle.
  • But the picture is VERY clear! This is the item she "thought" she'd bought. They look NOTHING alike
I know nothing about Lotsa bear, but (apart from the box) I'm afraid that they look VERY alike to me!

    I've been Money Tipped!
Its says Lotso bear because it IS Lotso Bear. It looks NOTHING like the other bear in terms of fur etc. If it had been the all singing, all dancing one I would have said so. My other listing for that particular bear says what it does. I've just never thought before to list what a toy DOESNT do..... For me, if I was bidding such amounts, i'd at least know what the item I wanted looked like.

So why exactly did you create this thread if it wasn't to gauge opinion? It looks to me like your only support is from other ebay power sellers. YOU know the difference, the average buyer doesn't. If there is likely to be misinterpretation then it's up to you to make sure it doesn't happen.

Yes, the buyer could have asked a question IF they knew there were 2 types of bear, they obviously didn't. From the way you've acted so far in this thread then I'm pretty glad I've never purchased from you.

I am not a power seller and I support the OP.

    I think it's Buyer's Remorse.

but if they both looked different then your own fault.

Hardly my fault - I was buying the item on eBay with only a picture to go by. Of course I would assume it is the one I wanted.

Buyers are not usually in the position to see the item they are buying fully before they buy and you have to make it clear exactly what they are getting because you cannot rely on them asking questions to see which version of it it is. You would lose a not-as-described dispute, so it's your responsibility in future to list as clearly and accurately as possible so the buyer is clear as to what they are getting.

If you've made the mistake and possibly misled her into buying, you owe her the return costs as well.
No the OP has not if they used the picture posted in the listing the interactive toy looks totally different to the plush cuddly toy.
The buyer is trying it on big time and really needs to be banned from ebay for requesting details as a means to intimidate.
Block the buyer then tell them in no uncertain terms where to go.
This happened to me once when in my own ignorance I bought the wrong toy from toysrus for one of my kids and then decided instead of taking it back I would sell it on ebay.
Some idiot buyer made the same mistake as me how I do not know how as the picture I listed was of the toy I bought and you could not mistake it I also included in the listing that it was not the toy I had originally wanted.
In fact that is why I did not want to take it back to toysrus as the packaging and toy looked so completly different I did not want to look like a fool.
Anyway I forgot about it and a few weeks later I got negative feedback and the buyer requested my details and then started sending emails to me stating they were going to take me to court and generally harassing me.
I phoned ebay and now that buyer is no longer a registered user as ebay banned them for getting details just to use for harrasment and the negative feedback was also removed from my account.
OP contact ebay by phone and inform them about what is going on and I am sure you will be happy with the outcome.

Don't eBay rules allow the buyer to return it under DSR rules, regardless of reason?

  • No. It was an auction, not BIN.
