but if they both looked different then your own fault.

Hardly my fault - I was buying the item on eBay with only a picture to go by. Of course I would assume it is the one I wanted.

Buyers are not usually in the position to see the item they are buying fully before they buy and you have to make it clear exactly what they are getting because you cannot rely on them asking questions to see which version of it it is. You would lose a not-as-described dispute, so it's your responsibility in future to list as clearly and accurately as possible so the buyer is clear as to what they are getting.

If you've made the mistake and possibly misled her into buying, you owe her the return costs as well.

But the picture is VERY clear! This is the item she "thought" she'd bought. They look NOTHING alike. She should have done her research.

You know what they say about assume making an @ss out of you and me ;)
Never assume anything, especially on ebay. Ask if you are not sure and save yourself being a @ss.

OP you have not misled anyone, its completely different to the interactive one. Its like bidding on a cow and moaning when your cat doesnt turn up :D She has buyer remorse, that's not your fault. Sit back and enjoy your £34 and wait for your letter of Mickey himself :rotfl:

I would tell her where to stick it! The buyer should have pressed the ASK SELLER A QUESTION button to make sure!!! You put a photo on so she could see it, and you are not responsible for listing what it CAN'T do..you would be there all day!!!!

It looks completely different to the interactive one! If the guide had the exact same cover design as the other one then yes, it should have been mentioned but if they both looked different then your own fault.
Anyone interested in buying my car? Advert below before I add to ebay.

For sale-Fiat Punto 1.6 in red. THIS IS NOT A PORSCHE. It has 5 doors. IT IS NOT A BUS. It goes well and is a good runner. THIS IS NOT LINFORD CHRISTIE.

    Love it!! :D

There's no need to take that attitude. You are always responsible for what you sell, so it's up to you to make sure what the buyer knows what they are getting. Don't misrepresent what I'm saying: it's not silly or far-fetched to suggest that the OP's listing could have made it clear it was not the interactive teddy and that's VERY different from what you are all making silly, juvenile jokes about.

You're dealing with people's money here. None of you come across as people who really care about the people they sell to and that is only going to make things worse, not better.

  • Thats a little unfair. I DO care about my buyers, but i'm not going to offer a refund because someone "assumed" something was something else! Thats THEIR error NOT mine. I personally make sure I know what i'm bidding on. If I had been buying one of these bears, a) I would have known from looking at it that it wasnt the talking one because I KNOW what that looks like & b) if the description hadn't mentioned it was an interactive I would have ASKED the seller NOT assumed. You can't just assume on eBay, & if you do then thats your problem NOT the sellers. I listed my toy as a 12 inch lotso bear. It IS a 12 inch lotso bear. The interactive one is bigger than that for starters!

I bet if this had been posted from the buyer's point of view most people would be saying it was their responsibility to check the details before buying!!

As the OP says - if you wanted the interactive bear and it didn't say in the listing it was interactive you WOULD ask!

It's like me buying a car and then taking it back because they never said it was a sport...therefore it should have been because I wanted one and it didn't say otherwise!

Whether it was a car or a toy they were buying it makes no difference, the listing should have been read properly and questions should have been asked by the interested bidder BEFORE bidding and winning let alone paying for the item!!!

OP, I can't find a 12" Lotso bear with a stick like yours. All the stick ones are described as 7" or 8". Are you sure it was 12"?
