    Hi,

    I was wondering if anyone can help... My mum recently stopped claiming for Jobseekers allowance and applyed for disability allowance. However, she was denied disability allowance. At present, she is not claiming anything, and will not be claiming Jobseekers Allowance. Is there any other benefits she may be entitled for as she has no money coming in?? :think:


    I would see about getting hold of a copy of the medical reports that were used to deny her the benefits.

    That way you will be able to see if she was denied on fair grounds or not.

    It is possible she is not entitled, or equally she could be entitled but the medical report could be full of lies.

    Only way to find out is to ask for a copy of the report.

    If she cannot run her life, is she going to be able to cope with work?

    If she cannot cope with her life, can she cope with putting in an appeal on time?

    Are the mental health issues severe enough to warrant a late appeal, would a member of the medical profession agree that her condition was such that it would mean she would be unlikely to appeal on time without help from third parties?

    I know you think the worst of anything to do with the DWP, but have you actually read the rest of the thread? There is a big difference between someone being incapable of managing their affairs and choosing not to do so.

    She has disowned all her family apart from me and my sister. My sister lives far is is married with kids, so dont want to put pressure on her. No family or friends in India...

    I'm curious about the OPs mum's change in attitude to claiming benefits.

    Was it the case that she actively resisted applying for any benefits, forcing the child to feel guilty about her deprived circumstances and to then subsidise her for 8 years, and then she had no choice left when the OP was unable to continue to pay?

    In other words, was the OP blackmailed into this until such a point when the OPs mum had no choice but to apply for something she actively resisted before? Or were there other reasons, such as having too much capital to be eligible for certain benefits?

    is there any to prove this isn't the case? From what the OP has said, it seems as though her mum may have minor mental health issues. This alone shouldn't stop her working, or cause any care or mobility needs.

    Entitlement for ESA etc does not just depend on what a mother says though..

    The OP works with people with MH conditions, they are in a pretty good position to comment on how bad their mother is.

    To suggest that someone with the condition that the OP has described may not be capable of managing their own affairs is disrespectful to all those with MH conditions, including people who are much worse than described, who battle on because they have to.

    Mental capacity is a very serious area, and to suggest that someone might lack capacity has implications far beyond an ESA application. I think you need to get a little perspective.
