Someone else's order was short of the Merlot, so I think you should contact the store and tell them. Then, they decide for you, problem solved

They have tried to contact the store with no joy.

Depends on the supermarket but I had a bag of shopping that was not mine (sadly it was boring flour and individual jellies, no wine!) but on ringing the supermarket, I was told to keep them. So enjoy xmas & get sozzled! You did your best.:j

One of my friends received items that they had not ordered in their tesco delivery, when they pointed out the error Tesco informed them that they couldn’t take it back because of health and safety reasons…….

The £40 wine probably cost the supplier no more than £10-15 and for them to organise the retrieval of it, let alone exceute the retrieval will cost around £10 (or more), so their loss is probably £5 or less. Yes, you should make the wine available to them and yes, you should make some effort to let them know of their error. However, you should not feel yourself under an obligation to commit heavy telephone expense or your own time to a value greater than the £0-5 benefit to the incompetent supplier. You may however still feel that you should not benefit (£40 to you) from the supplier's incompetence, in which case I advise you giving the bottles to a local charity for inclusion in a seasonal raffle (you might keep one bottle for yourself as reward for incurring time and cost of the unsuccessful telephone call and organising the gift to charity). If you somehow think you are 'entitled' to keep all the wine without any effort to return it to the supplier, then you have a problem: drink the lot quickly and hope it makes it easier for you to live with yourself!:A

I find it hard to beleive that the average citizen would not keep the wine without much of second thought. TBH I would just think "bingo!" and the thought of trying to return it would not even cross my mind. The most I would do would leave it unopened for 30 days in case they did try to retrieve it, and if they didn't glug glug glug ! :-D

Too right i would keep the Merlot, and if i didn't like the wine i would take it back saying they had sent the wrong stuff and get a replacement, possibly a bit rishy just dont let them see the original order!

  • Being kept on hold for 30 minutes is outrageous and all credit to you for persevering. My advice would be to try once and only once more - either email them or call them free or cheaply (saynoto0970.com should give you a non-premium rate number). Tell them what has happened and resist any request either to pay for the wine or to take it into store. If they want to collect it, then fine, but otherwise they will probably just write it off.

You should send a letter to the supermarket telling them what has happened, giving them a reasonable time to collect, say 14 days.
If the wine is not collected by then it is yours.
Anything else is THEFT and you could be prosecuted.

I have had free additions to my shopping more than once with Tesco and was told to keep it as it's more trouble than it's worth for them to collect it. It's a mistake so they don't know you didn't pay for it; how would they know to prosecute you?

I too am surprised at how everyone is justifying their exhortations to be dishonest - given that the chances are that if the OP does get in touch with the store, they will tell them to keep it, it seems churlish to go down the 'two wrongs make a right' rule. Anyone complaining about being overcharged - have they ever refused to correct their mistake? If you really think supermarkets are such evil entities, then don't shop there, but don't use it as justification for keeping goods which you know aren't yours.

I have been in a similar situation, and as everyone on here seems to be saying, when I drew the matter to the store's attention they told me to keep the goods. Given that most supermarkets seem to go by the policy of allowing the customer to keep the goods, I would send them an e-mail and see what they say.

One thing that boils my blood is being overcharged in supermarkets it happens all the time, and I have to spot it and waste my time waiting at the cs desk for my money back which sometimes is only say 20p. I know it's a mistake but it's theft, if I stole from them they'd have me arrested but I rarely even get an appology.
So based on that I'm of the opinion it's up to them to spot it and contact you for the wine back, and if they did phone me for it I'd put them on hold for 10 mins too.

    I so agree with you.
When they over charge me, I have to discover it & visit their customer service desk.
Its up to the shop to spot it, just like they do to us;););););)
