    sent first letter off on feb 27th, second threatening court on the 12th feb
    received letter today

    Absolutely the wrong thing to do and certainly not to be recommended that anyone estimates 6 years charges on the strength of 4 months of statements.

    Your list of charges, dates and descriptions forms part of your defence and if you can't back this up your case is likely to be thrown out.

    Wait on your statements/information.

    Here's a question for fellow members.

    As I've explained in earlier posts, I sent off the recorded delivery claim on March 6th and got the standard 8 weeks reply dated the 16th.

    Because of the dozy pillock who delilvered my letter and who didn't scan the recorded delivery signature the Royal Mail can't tell me when the letter was signed for.

    Do I work on the fact that the letter was probably delivered on the 7th or 8th March and send off the stage 4 letter threatening court action or is it safest to give them 14 days from the date of their reply i.e. 16th March.

    Your advice would be much appreciated.

    hi, thought i'd give you my experiences with halifax.

    wrote to them at the end of january to my local branch requesting 6 years statements and enclosing a £10 cheque. recieved a letter the following day returning the cheque and saying they had ordered the statements for free as a gesture of goodwill.

    totalled up the charges and they come to 850 + 140 in interest.

    wrote to the bank asking for money back, they replied next day saying "no" and enclosing a copy of their t&c's etc.

    we followed this up with another letter threatining court action. once again, they wrote back and said "no", but that they would pass the letter to the legal deaprtment now we had mentioned taking them to court.

    the next day I had a phone call with an offer to settle for £500. I declined this but she would not budge on the phone, and said she would write to me with a confirmation of the offer.

    this came in the post, and we sent a letter in reply declining this offer, but saying we would accept £800 and not take the matter to court... we gave them a 7 day deadline before we filed at the court.

    the deadline expires on monday, and they still haven't contacted us. we will file with the court the day after the deadline (tuesday 27th march) for the full amount of just under £1000 including interest.

    Im bad at money management, bad, awful! I keep seeing the chat about "claiming back your bank charges" and thought, NO WAY would the bank listen to me, I must be one of the worst culprits!:mad:
    ANYWAY, after months of "umming" and "ahhing" I sent off the Template letter featured on this site to my bank (Halifax).....
    Approx 6 weeks later, I have a letter back from them...AND A FULL REFUND OF MY CHARGES:iloveyou:
    OMG!! I CANT BELIEVE IT!!!
    :eek:

    So dont give up, DO IT...they have not shut my account, they were not nasty..DO IT DO IT DO IT!!!!
    Cannot recommend this site enough...

    Hiya

    I received my standard 8 week letter on the 22nd March & sent off the step 4letter 1st recorded on the 23rd, so am giving them 14 days as of Monday as they should receive by then (will check track & trace). If I've not heard by the 10th April (taking into account Good Friday & Easter Monday) I will file a claim. Though I am going to call them before just incase it gets their bums moving...ha ever hopeful :rolleyes:

    From what I've read on here, we do need to give them 14 days before issuing a court claim, so get that letter out & good luck! x

    To dreamon re: your quote yesterday, dont be put off by the fact that you have a different sort of account. the amounts they charge are scandalous. £38?? how do they ever think you will get out of financial trouble if they charge you amounts like that?? Disgraceful.

    My advice is go get 'em! Remember, the Financial Ombudsman ruled that the banks arent allowed to close your account- if they do, you could be entitled to damages. so dont let that put you off.

    Loads of people on here who can help you and give advice- we're all in
    this together!!

    GEN ADVICE-

    1) I called this no to get my statements (08457203040) and they were here in 3 days! plus, it was only a fiver, not the tenner some of you have been sending off.



    2) Some people have mentioned that the bank are saying that the charges are lawful because its written into the terms and conditions of your account, and this was putting some people off. Contract Law states that the aggrieved party (ie halifax when a DDebit bounces) are only allowed to charge you an amount which would put them back in the position they were in before the DD bounced- ie NOT £30/£38 etc- this amounts to a fine, and is (probably) unlawful- so it doesnt matter what it says in the T+Cs. Eg- if it said in the Terms that halifax employees were allowed to come around to your house antime they wanted to throw a party, you wouldnt let them do it, just cos its written in the terms, would you?!!!:rotfl:

    Hi all

    Well Halifax have sent me the "8 week" letter so first thing Monday morning I will be sending my letter telling them they have 7 days or court action!

    I am now feeling very nervous, but after demanding their overdraft back I am going for it and they can have their overdraft back when they pay me what they owe me!

    Thanks to everyone on this wonderful site for giving me the confidence to do this.
