    Yeah I told him already, so basically the new law is still the same but I read, according to the new law the reg keeper must provide the name of the driver if he wasnt driving otherwise he is liable to pay the charge.

    The new rules have changed where the registered keeper is invited to name the driver, there is no must, there is no law requiring it. If the RK ignores it all then technically he could become liable if the parking company went to court. Let me show you a couple of stats that we know occurred in 2011

    1.8m fake tickets given
    845 small claims issued
    49 (forty nine) before a judge
    25 (twenty five) for the registered keeper/driver
    24 for the parking company


    So you do the maths, they don't do court, this won't change in 2012, 2013, or 2014 or ever
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    You're ALMOST there. If the RK doesn't name the driver, he will be pursued by the parking company instead of the driver. He's not liable to pay the charge though, that's a contractual penalty which would be chucked out of court.

    Oh, and the PPC probably doesn't even have the sufficient occupation rights of the land in question to pursue anyone for anything.

    We know, we have been discussing it since it was first put forward as the Freedoms Bill two years ago. But no-one is 'liable to pay the charge'.

    We answer this question about the 'new law' every single day. It just means that the registered keeper and the driver can both ignore the scam together!

    In that thread the OP has decided to appeal to the second stage using POPLA (then ignore it if the ticket isn't cancelled). There are dozens of threads about that option too. :)

  • The situation is, any legal charge becomes the responsibility of the keeper in much the way this is the case with authorities. Ultimately a driver will need to pay his penalty for parking on a double-yellow but if he doesn't, the keeper becomes liable and this is powered by statute.

    In the case of private parking companies, we have a case where they impose an illegal demand: since it is illegal, nobody has to pay it. However if they were being fair and only seeking the £1 which the driver never paid to park all day on a car park, then yes they could pursue the keeper and they'd have everybody's sympathy there.

    But this never happens....
  • ...so it is noit about the RK being obliged to name someone, it is about lawful charges becoming his legal responsibility. But like I said, there are no lawful charges in that outfit.

    I received a letter today from these scum bags saying if I dont pay them within 28 days £100 or tell them if I was not the driver than I would need to pay £150 once this period is over.

    I'm quite upset with the situation, should I tell them it wasnt me who was driving and give them some xyz name and address of our other property and once they send the letter there I reply them saying that this person moved home ?

    Please advise,

    Just ignore them, you don't have to pay them anything, if you wait long enough you'll get a 100% discount, that means not getting upset and actually laughing at their hysterical attempts to scam you. Would it help if you thought of them as Nigerian parking patrol office? because basically you would ignore a nigerian prince asking you for money, wouldn't you?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
