It's the average daily temperature that is used rather than whether the minimum temperature falls to or below 0c at any point during the day or night. Where I live today is the 12th consecutive day (and the 17th out of 19) where the minimum temperature has been at or below 0c but in only 3 of those days has the average daily temperature been 0c or below. Even if you do win your appeal it's likely you will still get contributory ESA which wouldn't qualify you for a CWP.sheffielduk wrote: »im waiting for my esa appeal so not in any group as yet.
Of course, now it's all moot as the Cold Weather Payments scheme for 2012/13 has ended plus any amount you could win on appeal will be contributory payments of ESA rather than income related.
Edit: just read your edit sheffielduk. If you win your appeal you will qualify for a CWP as long as the income related ESA is paid for a period that covers a period when your area triggered a CWP. This will include a period where any payment is backdated to.0 -

hi o/h added me too his claim we got backdated to january in march, would we be entitled to cwp as never recieved any?just phoned them and they said werent sure if would get backdated as the claim was paid out in march? these were our backdated payments from january?income based jsa from jan 2nd0

oh sorry i have child under 5 just wondered if claimbackdated to jan whether we would still get as wasent paid out until march0
