unlucky today on the tesco triple dect phone there was a yellow sel on the floor but next to the phone was the right price (does this count as an r+r)?0

Hi, I bagged a samsung E900 today and throughout the store they had 3 prices. I was charged £169.99,the out of date SEL was on a big cardboard sign/holder near magazines CS etc, and stated 10% off mobile phones. Upstairs ( where all our electrical stuff is) with all the phones it was correct price, and then at the end of the aisle it was £20 off with a £40 shop. I've never done R&R with an item of this value and the SA's tried fobbing me off with refunding the difference but I stuck it out and got it!!! so happy!!
so for all of you, check advertisements throughout the store not just near the phones & good luck!!

`To help clear up this debate surrounding out of date SELS meaning no r&r policy (where some CS staff and indeed some Dundee staff are concerned), I'd like to add the following:
The policy says "Where you are charged more than the price on the shelf or on the product you will get a full refund for the product, and get to keep the product".
Simply on a legal basis, it is in black and white, that you are due a refund if the price on the according shelf (implied: label) is less than the price you are charged, the Policy board does not mention ANY term regarding the dates on the shelf edge, merely the price. There is no "terms and conditions apply" on the board and they certainly can not add t&cs at a later date, as the contract has allready been formed with the customer at point of purchase. Therefore as the policy board forms part of the inducement of sale, it is clear that they HAVE to refundif they charge you more than the SEL price, EVEN if the SEL price is out of date, (or made out of gold, or smells like cinnamon .... for that matter .... it is the price on it that counts)0 -
I just spoke to Consumer Direct Regarding expired shelf labels for goods and they said the shelf label being there is still an invitation to treat regardless of an expiry date the till operator should refuse to accept your offer (offer to purchase at the lower price and ask if you wish to purchase at the full price, (chances are they would not know about the miss price and sell it the higher price automatically)) after the purchase of the goods at the higher price (unless asked if you wished to purchase at the higher price) some stores may offer a good will gesture to refund of the difference or a full refund and return of the goods to the store, so technically in tescos case the goods were miss priced and under their policy you should be entitled to a full refund and to keep the goods.
This is to my best knowledge what I got from the lady I spoke to at consumer direct this is my interpretation of the laws with regards this matter I’m not in a legal profession but have done a lot of reading up on various consumer laws since first finding this site.
So basic run down
SEL expired or not is and Invitation To Treat
you taking products to the till is The OFFER to purchase the goods at the price you were Invited to treat at.
Till operator selling you the goods is and acceptance of The OFFER.
Hence contract concluded. Item Miss priced Tescos policy comes into force.
Hope that gives some the courage they need.
I would contact Consumer Direct yourselves if you still unsure as i said this is my interpretation but i belive it is correct but cannot garantee it, gotta cover my own backside

hi, here is a list of what ive had over the last 2 days, there are lots to be had at the moment.
1x sony ericsson w300i
1x samsung e900
2x open season ds games
i bought the above together so i had the discount of 20 pounds on each phone because i had spent over 40 pounds instore, i paid with a couple of coupons so bill was 301 pounds, total r&r of 345 pounds, so came away with an extra 34 pounds in my purse. wahay!!!!!!!!!!!!!!!!!!!!
also yesterday i had the following
4 x 6 pack lamb chops
2x pork/sage chickens
2x bone in beef
2 x finest top rump joints
2 x psp x men 2.

Nice explanitory post...................................however....
Can you try to explain what to do when the manager is adamant that "Out of date" offers dont count, and HO backs him up....
Will Consumer Direct then intervene......
The actual law has been talked about a lot previously, but as i say....What happens when you get the Manager who says "NO"...........Ive not yet heard of Trading Standards/Consumer Direct/ASA acting on anyones complaint, and the plaintiff getting his RandR................
