  • Just been to my local Tesco and purchased 4 packs of meat. Shelf label said £3.97 per kg and £4.98 per lb. I bough this as my packet said £3.98 per kg and £4.98. They said its not an overcharge i disagree. Who's right? CS have referred me back to store saying this will have to be resolved in store. Taking it back for a refund!

    My posts asking about this misprice were deleted from misprices so is the 'Technika BB105 boombox £11.94, scan £12.97.' still scanning at £12.97 or has it been reduced to £11.94.

    The statutory rights cover issues such as product failure, defect, etc, which are there in most instances regardless of the exact contract terms, these are covered in the sale of goods/services act, fit for purpose, etc. Also if a product fails and causes damage it could again covered in tort, under negligence, duty of care, breach of duty, etc. regardless of where goods are free or not. Even if it is free a duty of care exists, ie don't do anything for free that your no good at because if you mess it up there could be a claim against you whether money was received or not.

    When a product is sold at a different price to that expected the contract can be declared null and void, part of contract law rather than statutory rights. Also Mr T can if it so desires claim a contact is null and void, if you enter into it knowing the price is incorrect. ie if you know in advance it is a mispriced, but this is difficult to prove.

    As for returning goods for which an R&R has previously been given this is covered by the own advertised promise, and the R&R should not effect those rights given by the promise, or they are in effect changing the contracted agreement at the time of R&R which the R&R promises not to do. Although, this are is more 'subjective'. But certainly if goods are defective, not fit for purpose, etc, there is no question, exchange or refund.
    Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:

    EVERY LITTLE EXCUSE HELPS in trying to get out of the R&R policy when the law has been broken, especially on high value items. :D
  • Is it me or is the misprice thread drying up...remember the days when there used to be pages full in 2 days.. now your lucky to get 2 misprices a day!!

    Walked out of two tescos last night without a bean free!!

    Warning...

    Did try the selection boxes tho..Cadburys as buy 2 for £5 and the Large cadburys had a white SEL..but this scanned correctly and offer applied!

    Everytime, it is legal and free money from Tesco's.

    Everytime I score an R&R and the 'very nice lady' forgets to mark up my receipt as refunded I return it to a different store or a different CS in the same store for a refund (28 day policy).

    Done this twice this week - £37.80 of Knats!!!! Lager and £34.90 of Lindt chocolate last night.

    The first refund when you keep the goods is Tesco's bribe not to report them to Trading Standards.

    The second refund is a separate and unconnected transaction when you return your goods that you own and have legal title in for a refund because you have decided you are not happy with them.

    What would you rather have, goods you don't really want (how much steak can you eat, lager can you drink or chocolate you can stuff!) or plain hard Sterling in your paw ?

    You're going to the wrong stores I've had a cracking week.

    This seems the wrong way around, especially as there is approximately 2.2lbs in 1 kg.

    I have noticed recently in my regular Tesco's that the pack Kilo prices on the steak are lower than th SEL's. I wonder if this is Tesco revenge on slow thing R&R's who notice the price difference but don't realise it is the wrong way around and therefore no R&R, and then counting on most people being to be too embarrassed to ask for a plain refund.
  • Just picked up a large chicken, shelf price £1.88 per kilo and pack price £1.99 per kilo. Thought my luck was in but no - when I got to checkout the price was 2p lower than that marked on the pack - drat! :mad:
