If it was the same scenario as mine, they have no leg to stand on. Although I have seen both white SEL's with single price (no leg to stand on unless other stuff makes you aware that condition applies), and yellow stickers (with several discounted prices, that also make you aware that they are intro/discontinued, here they should if the CS is awake, you should not get away with it, as the R&R does not apply, as the item already details that the discounts are already applied in the offer terms).
If there was a single price and no indication within it that it has already been discounted, you are not expected to know that it has, or has not. Thus you have to assume that the 10% discount will apply as it has not been informed to you that the phone is either discontinued or introductory (think that these are the two clauses, it says if disc/intro then all discounts are already applied and no further ones will made made, or something along those lines).
Therefore single price not indicating the fact it is disc/introd = 10% discount or R&R, the price marking order laws cover ambiguity in pricing, needs to be clear, concise and non-ambiguous, or something like that.

Yes, I think anyone who has been R&Ring for any length of time has had this happen to them - has anybody ever asked to see the cctv footage as "someone is obviously tampering with your sels !"
I wonder what our resident Tesco managers would say/do if a customer did ask to see the footage - are customers allowed access, and how easy/quick is it to retrieve footage ?
Of course I assume that such underhand tactics wouldn't be needed in your stores, as you would rarely have wrong sels up......but what if a customer DID ask to see it ?0 -
Popped to Tescos tonight - not a thing!!!
Champers was SEL £20.xx, Lindt chocs £3.49 - no yellow sel, Pringles offer was no longer on!!!! Phone was on yellow SEL clearly marked down wih discount!!
A pricing girl was wandering round printing new SELs.
Did spot a Dr Who dvd SEL £19.99 price on pack £9.97, but no working scanner to check - maybe worth looking out for though!

Looks like Tesco have addressed the X-Box and game bundle, a new nationwide bundle is on its way (already in some stores) and I look forward to it being rolled out soon in every store !0
