This applies if they withdraw it from sale BEFORE its paid for.
Any price indication is merely an invitation to treat in law. Only when a formal contract at POS where goods, are exchanged for consideration (cash/credit/vouchers), is a legally binding agreement made. Although the CPA applies where the do advertise a product at a price which they are not prepared to sell at, the case law is that of a Esso Vs HM customs and excise.

    Sorry, even more confused now.:confused::confused:

FloFlo - Not really sure what you're saying here.

DD - The OP said that when 2 prices are quoted the retailer has to sell at the lower price. Are you saying that they don't have to but if they don't they can be prosecuted under CPA?

If you pick up a product and pay for it you should have been charged the lower price displayed, however if a retailer noticed a mistake before you payed for they can decide to withdraw it from sale.
  • Was this an expired SEL, or a misprice on their system?

No it wasn't an expired SEL, just a normal white SEL.

Someone else has managed to get the same thing at their tesco too.

Ahh, I think I'm getting there. So, they don't actually have to sell it at the lower price (base on what DD said) But if they continue with the sale and charge the higher price they're open for prosecution under the CPA.

    Thanks FloFlo

some simple rules are needed for the r+r virgins and greedy ones.

    1. use cash only
    2. do not use a clubcard.
    3. always buy things like bread and milk and normal shopping items. this will look like u were doing a normal shop.
    4. only buy 2 electrical goods max at a time. or 3 joints of meat or 3grocerey items max. this is what most normal shoppers would by in a weekly shop.
    5. do not draw attention to your selves. IE. crouching on the floor next to a sel and looking at it real hard for 30 secs. the security guy will soon clock u. and think ur up to something.
    6. find a young cashier. they are normally not bothered to look at stickers or price on items.
    7. go-to stores at different times of day. but only r+r in that store once a month per shift.
    8. when at c.s desk look confused asking could u do a price check for me as i think I've payed more than the label on the shelf or the sticker on the goods.
    9. be aways polite and friendly to the c.s staff and management.
if u are refused a r+r on a phone or high price item and ur till receipt is unmarked go-to the next store around u. and get a normal refund. saying its not the one he wanted. remember phones and electrical items are covered by a 28 day no fuss return policy even if u have used it.
    10. Treat r+r a game. like cat and mouse. whenthe c.s person only gives u the differance first. say" when i was waiting for u to check the label i noticed the board behind u ........and is it true that u will give me a full refund and i will get the goods for free?
If that don't work ask for the manager for any high price goods or just walk away for the next store down the road.
10 A...If u don't win the first time don't get angry. Get even at the next store down the road. NEVER THROW TANTRIONS ON THE SHOP FLOOR AS THIS WILL GIVE THE MANAGER THE EXCUSE TO BAN U. I've been warned by different managers with excuses like
" Ur not allowed to look at Ur till receipt until u have left my store." or
    " Ur a professional shopper arnt u."
my reply once was to this was yes i do mystery shopping for certain company's. maybe i'm doing it now so u better be quite... never had trouble again when he spotted me at the c.s in the weeks later on
The worst thing that has happened to me was the manager had told the store c.s desk to look out for me when i entered his store. For 3 months as soon as i entered the door the tannoy would blare "deputy manger to c.s desk please".
Even been followed around by security and staff. even noticed the cameras following me around.
But i have not posted on here for 3 months and no r+r for the same time. but i back now and having a great time. only £257.87 this week in 5 stores.
    11. BUT THOSE WHO GOT GREEDY WITH THE CONSOLES AND GOT WARNED OR BANNED. DON'T GET GREEDY AGAIN BUT BUY BUY SMALLER ITEMS IN STORE FARTHER AWAY.
HOW WOULD THEY KNOW ITS U. BY PAYING CASH AND NOT USEING UR CLUBCARD. U MAY SKIP THE TESCO RAIDAR.BUT BY BEING GREEDY AND DRAWING ATTION U WILL BE SOON RECONISED
    12. IV NEVER BEEN BANNED YET. BUT THEN AGAIN I NEVER DRAW ATTION TO MYSELF.
TESCO R+R RAIDER. OTHERWISE KNOWN AS SEXY SARAH

As I said in the title, this is no doubt going to cause me some agro.

I think there is a lot of rubbish in this post.

If this was intended solely for newbies, then I may just have ignored it, although the contradictions in it are enough to baffle newbies.

As I am possibly classed as being one of the "greedy ones"....No one know mine or my families situation or circumstances, so as The Dude professes often...."each to his own"

I've never filled my trolley, but have certainly had more than the 3 items as mentioned above..as I know loads of us have.

I've also hit quite a few stores in a row for consoles and the same for phones, but didnt go back again for a while.

As for making sure you get the bread and milk...Well....yes if youre getting meat, but no if its an Xbox.

How can you brag about "not being banned", but then say you were followed round a store for 3 months....Why didnt you just use another store........thats worse than my bans....which dont work any way....they dont know me(as i stayed away for a week, and they forgot me)

As for warning the greedy , and those who got banned....A lot of us might say it was worth it (£3000+)....As the bans and letters are all "hot air"...it just drives us underground for a while.

As for saying "dont use your clubcard"....You say you dont, but your signature seems to say you do.....you brag about your Randr total

I realise you've withdrawn your "mystery shopper" excuse

There's not many people on this thread seem to have drawn as much attention to themselves as you seem to have done.

Your post annoyed me and felt that you had no qualifications to draw the conclusions you do about others, or offer advice.(except to newbies)

So if thats you in your avatar...Hello Sexy Sarah.....

Hi....it isnt nationwide....the price is the same, but the stores I visited today all had yellow SEL's with crossed out £129.99, crossed out £89.99 and then £74.97

I still thought there was a chance of an RandR as the poster didnt mention "discontinued"....it only mentioned "introductory"..However after some harsh words with a manager(apologies to !!!!!! Dastardly...as i almost lost my cool) I took the refund.

It wasnt until I got home and read the A5 "10% off" leaflet, that I noticed it said...No further discount to be applied to discontinued range.....So although the manager was correct, she didnt prove it to me....I found out myself.
    [/QUOTE]

That's the one I saw, thought that even with a bit of luck and some classic arguing it would be more than difficult, as the small print on poster, as you point out which I read, said the no further discounts, blah blah stuff
Drat and Double Drat, curse that Mr T excuse for not giving me a refund.

Went in 5 stores tonight, all stores had these on plain whites SEL's, the Sels showed no previous discounts applied. Have a look around !

It took some debate, but managed to bag 2 phones without too much trouble

    Easy money !!

will go back and grab the phones at some stores further away from tomorrow.

FloFlo - Not really sure what you're saying here.

DD - The OP said that when 2 prices are quoted the retailer has to sell at the lower price. Are you saying that they don't have to but if they don't they can be prosecuted under CPA?

Contract law and the CPA and its various sub-sections and related acts cover different things. Contract law is offer, acceptance, and consideration (plus a couple of minor things can't remember them off-hand),which results in the formation of a legally binding contract between buyer and seller, and vaious other obligations.

If the retailer has a poster up, saying meat £10 he can refuse to sell you that at £10, he has no obligation to sell you any item. In point of fact even after he has sold the product he can declare the contract null and void if you knowingly went into the contract knowing the price was more/less than £10.

However, if he has a poster up saying meat £10 and will not sell it at £10 then he is in breach of the CPA, not in breach of contract, because in terms of contract law the said poster is only an invitation for you to make an offer to buy the item, (an invitation to treat), this legally terminology was brought into contract law to avoid legally binding people like auctions, or 'powder puff' advertisements, where the price stated may not be the actual selling price.

That is why the CPA protects the consumer against companies putting up posters etc advertising products for sale at prices they will not sell for. However, given that TS have little in the way of real balls on this issue CPA prosecution is very unlikely in most instances, unless of course the government have something to gain, which was the main test case in the area, which revolved around Esso and HM C&E, and was to do with the forecourt petrol prices.

Clear as mud me thinks !
