  • 4 R&R's today totalling around the £180, beer, dvd's, meat, books, the usual culprits. All given without any bother whatsoever, unbelievable, one of the ladies that dealt with me had dealt with me previously and used to be a right old dragon, more hassle than a bag of nippy crabs, in fact another poster, had been practically thrown out of the store by her on one occasion. But still no bother even from her.

    Tesco's what is happening the arguement is all part of the fun, now I'm going to have a lie down to recover and then I suppose I'll have to argue with the wife, which means no hanky panky for ages !! Tesco's you marriage wreckers !!!

    What's more even with out-of-date promotions no bother, these used to be a real fight in the 'old days'.
    Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:

    but what would your argument be if you said this to them before you had the phone/game etc in your hand and they decided it was "conveniently" out of stock? cos we all know how awkward some CS can be :rolleyes:

    This actually happened to me with a Console and game......The manager agreed it was a misprice, gave me a refund and asked me for a phone number so they could get in touch with me when they had one in stock. She rang me 2 days later..........It was waiting for me with "Just to be given to Customer" written on the bag.

    I think however that manager may have been the exception rather than the rule.

    On the subject though, a contract has been made when they take your money, so the RandR bit should be honoured.....even if they have to get you one from another store.

  • This is confusing me a bit. I rang Trading Standards a couple of weeks ago and posted an outline of the conversation on here. One of the things they told me was that a retailer doesn't have to sell at the advertised price. Why does quoting two prices make any difference to this:confused:

    Any price indication is merely an invitation to treat in law. Only when a formal contract at POS where goods, are exchanged for consideration (cash/credit/vouchers), is a legally binding agreement made. Although the CPA applies where the do advertise a product at a price which they are not prepared to sell at, the case law is that of a Esso Vs HM customs and excise.

    This was the reason for my comments to you earlier, while we are always prepared for confrontation, more often or not everything is conducted quite civilly..........which is a complete turnround from attitudes a month ago.(or 7 months ago as the case may be)

    A year ago you would have been escorted from the premises by several burly security guards, or threatened in the car park, or almost definitely had a argue on all of those refunds I had today, escpecially if you did not know the ins and outs of both retail law, contract law, etc and of tesco's policies. How long the nicey approach lasts will be short I would imagine, especially as xmas appraoches that mess-ups increase exponentially.

    edit ; I don't know who's around from the old crowd but I seem to recall similar events last year, around August/september loads of bans, threats, one lady confronted in the car park I recall by the duty manager, etc, then a polite period for a while until maybe november, then back to the above as xmas approached. Maybe its seasonal ? :D:D Maybe effecting there hormones ??:D

    A big Thanks to BFG !! see below for his post from earlier today

    Grabbed myself two of these on r&r today, normal white SEL, but discount didn't kick in, all other phones have SEL's that show the discount (this one doesn't), they may use the get out clause of "its an introductory phone offer" in which case these sels don't show any discount.........BUT..........all the i ntroductory phones are clearly marked "introductory phone"

    This is nationwide and well worth the hassle of a little debate with CS staff

    Here's a one that has worked for me.

    Showing in all stores I visited...Motorola SLVR L7 - (the black one). The white SEL says £74.97 and this is what you get charged. However....


    There is a 10% off promo on ALL PAYG mobiles; all the mobs (except the SLVR) have a yellow SEL showing the previous price crossed out and the 'current price' (inc the 10% off). This is what they have to do to show that the price includes the 10% off.

    THe SLVR has only a white SEL with no crossed out previous price - so that indicates the price pre-10% off.

    There is a disclaimer in the 10% off flyer that basically says 'excludes introductory offers and discontinued lines'; - however the SLVR is not marked as falling into either category (again there are yellow SELs on those affected).

    The reality is that the SLVR should have a Yellow 'Discontinued' SEL but for some reason stores haven't put it out.

    It needs a good argument to stand any chance of getting R&R on this - basically along the lines of

    1. It's not marked as Introductory or Discontinued, so 10% off should apply
    2. Since it doesn't show the previous price and the new 'after 10% off' price (as per all the yellow SELs), the price shown should be considered the 'pre-offer' price and should be subject to 10% off

    You also need a bit of a brass neck (and other body parts)!!!!!!!!!!

    The only time I saw this phone it was clearly marked as discontinued or introductory, can't remember which. Or I was lining this one up ! Drat and double drat !!


    Nearly all the stores have these marked with a plain white SEL ...........There for the taking !!!..Nationwide !!!

    Went on a 'tour de tesco' to find the Pink and Brown Filofaxes today got lost for a while but when I got there to see them on the shelves with the 12.97price displayed on the box and the SEL price of 14.97 i thought it the trip was worthwhile until they scanned at 12.97 ???????????? So everyone BEWARE of this.

    Hi....it isnt nationwide....the price is the same, but the stores I visited today all had yellow SEL's with crossed out £129.99, crossed out £89.99 and then £74.97

    I still thought there was a chance of an RandR as the poster didnt mention "discontinued"....it only mentioned "introductory"..However after some harsh words with a manager(apologies to !!!!!! Dastardly...as i almost lost my cool) I took the refund.

    It wasnt until I got home and read the A5 "10% off" leaflet, that I noticed it said...No further discount to be applied to discontinued range.....So although the manager was correct, she didnt prove it to me....I found out myself.

    If the SEL is white you should be ok.....but you might have a losing fight if its yellow......Good Luck.
