    I've never heard of that 1 year rule. I seem to remember reading somewhere (Direct Gov, I think) that up until the child is 12, they can limit the hours they work.

    This is a Labour policy that was due to be implemented this month anyway, nothing at all to do with the spending review.

    Hi,

    What is the 1 year rule? Will someone please be able to help, we are at our wits end here trying to get advice from everywhere and anyone :( A relative suffers with mental illness and the ESA 'assessment' is not good for assessing this. He went through a protracted battle with Atos and DWP for almost a year and was awarded it a few months ago after much distress. He then got a letter a day after the spending cuts with an application like he'd just applied for ESA again. He's distraught thinking he'll have to go through it all over again. Hes only just been to a tribunal and they said he'd be fine for 3 years. I don't know what I can do to help, you seem to hit a brick wall whenever Atos is involved. He's supposed to be getting better for work but this has set him right back, he can't get out of bed or anything due to the worry :(

    Hi,
    This depends very much on which group he was put in - was it the "basic" Work Related Activity group (which most people are in) or the Support Group - if it is the latter, he is safe - it is only the Work Related Activity group that they are threatening to change
    And anyway - it is only "Contribution based claimees" as opposed to "INCOME based" - so unless he has savings of over £16,000 and is in the WRAG - he should not notice any changes ............

    Thanks very much for your reply! He's in income based WRG and like I said, got the letter the day after the spending cuts, we couldn't believe it! If you don't laugh you'll cry :rotfl::(
