Sportsworld - Are They Breaking The Law?

Dudes,

The wife purchased some sportswear from our local branch of Sportsworld - got home - it didn't fit.

So back into town we trot today - with the goods and receipt - big sign at the desk saying 'refunds only given for goods as described in the Sales of Good Act'.

To cut a long story short - a huge debate with half the store assistants and management who were refusing a refund and kept offering a credit note.

Eventually got a refund - I kept pointing out that the goods were not fit for purpose.

The manager said the refund was a goodwill gesture.

Was I in the right?

    If the goods did not fit and are still in the condition you purchased them including tags still on then I cannot see what the problem is as they can just be re-sold as it is not like underwear which is not refundable

    Do they have a refund policy on their website

    I would only accept a credit note as a very last resort as once you accpet it you appartly lose certain rights according to what trading standars told me a while ago

    I don't think you were in the right, no. The shop only has to offer a refund/exchange on faulty goods or good not as described. Just because your wife chose the wrong size, does not entitle her to take them back. Any shop that does this is giving you an extension to your statutory rights, it is not a right in itself. The manager was right, it was a gesture of goodwill and more than you were entitled to. The only way I would see you could rightly ask for a refund is if their sizes are clearly not in keeping with what you would expect or they offer no opportunity to try them on.

    If you purchase something and then decide to return it because it doesn't fit/you've changed your mind etc the shop does not have to give you a refund or even an exhange.

    Obviously lots of shops do but they do this purely as a goodwill gesture but they really dont have to.

    More and more shops are tightening up their refund procedures due to people taking advantage of them (I am not suggesting op did thisof course) - i'm not suprised that Sportsworld have done this and to be honest I imagine more shops will be following in the future.
    Sometimes it's important to work for that pot of gold...But other times it's essential to take time off and to make sure that your most important decision in the day simply consists of choosing which color to slide down on the rainbow...

    sounds harsh... but just because they are unsuitable for your wife does not mean that thye are unfit for the purpose.

    To be fair, they have always had that policy and it is displayed prominently in the store. Fact is, we all shop at Sports World for one reason and one reason alone - it is cheap as chips. As is their after sales (in fact, pre-sale) service. You get what you pay for in this instance...
