Forward Cellular Have Gone Bust

  • It was last year and I had to phone twice to get onto it - first of all they said £15 was the lowest tariff (I knew they did it because my sister got through to a very helpful person who told her about it!)

I can't remember what the £5 tariff was called but it's VERY limited - think you could only receive calls with it!!

Could of stopped doing it I guess but worth a try
  • Sorry...I changed onto it after only 4 months (Maybe best to say you got nothing out of the deal - i.e. crap phone or no phone otherwise they will think you are profiting and won't let you do it!). I got a really crappy fone from mobilerepublic as part of my deal - was worthless.
  • Sorry to hear the news. I've had phones from fwd cellular in the past and always found them excellent.

I work for an insolvency practitioners. I'm afraid that the news for all of the people waiting for cashback is that the chances of getting anything back are very slim. The only preferential creditors will be any employees (but we thought they were a one man band anyway) so everyone will have an equal share of any assets sold. However the chances are that they won't have any / many assets.

People waiting for cash back cheques have entered into two contracts one with the network provider (i.e. Orange, T-Mobile etc.) for and one with Forward Cellular (for the cash back).

You won't be able to break your contract with the network provider but you could try and be moved to a lower monthly tarrif. This may of course means you breach your contract with fwd cellular (the network provider would be looking to clawback from fwd cellular) but frankly who cares you've breach your contract with fwd cellular. This may be an attractive option for people who've already had their cashback.

Trying to get back to the point people who've not received their cashback have a claim in the liquidation of fwd cellular for brwch of contract but if there's no money to pay there's no money to pay.

    Sorry for the bad news.

Sorry, normski, but the cashback creditors WILL be behind:

    1) The insolvency practitioner (thought you would know that if you work for one!)

    2) Any lender with a fixed charge (eg. their Bank)

    3) VAT payments owed, PAYE owed, National Insurance owed, wages, holiday pay etc

    4) Any lender with a floating charge (again maybe their Bank)

After all the above have been paid the creditors will share any remaining funds.

I was told that I could change to £15 month today(50minutes/month) but I'd have to use up my free minutes for this month or lose them
  • Dear Smartass

This isn't a pop at you in any way shape or form but the position change with regard to Customs and the Revenue in September 2003. Yes you're right about anyone with a fixed or floating charge and fees but was trying to keep things simple.

Please don't take offense at my reply (I've seen the spats that some people get into) and I always read your posts with great interest.

    Regards

  • Hi Normski

    No offense at all!

(Though I take it you do also agree the insolvency practitioner comes first!!)
  • Sad news indeed - they were excellent - feel for those that still have cash outstanding.
  • This is second hand information, but I thought it might be worthwhile repeating it here for anyone in this situation...

Some people on usenet have reported that the insolvency practitioner believes that there might be anything up to 50p in the pound available to creditors.

Also, off-the-cuff comments from the insolvency firm concerned have implicated the VAT man as the catalyst in this situation...

  • if anyone is due cashback, do they need to do anything? i.e. let any know or register their interest in a list?

Or will having returned their bill etc count?

    Still gutted about this
2p off is still 2p off!
