Similar situation to Liam above they are offering an ex gratia payment of return of premium plus 8 per cent interest. They have asked me to complete an acceptance form and they will then calculate the amount due. Just a bit concerned that if I sign the acceptance form they can then still delay repayment and as I have accepted their offer I cant take it any further. I think I will sign and return the form within covering letter saying am going to fos if they don't pay into my account within 2 weeks.
Just as a postscript I suggested my husband rang ltsb today as he also has a claim for misselling outstanding. He was told that his acceptance slip will be sent out today but that the repayment will be paid directly into his loan account and the amount outstanding under the loan will be recalculated deducting the repayment. The loan under which I have received the letter detailed above is also still outstanding but theres no mention of offsetting the repayment against the outstanding loan and they ask for account details to repay the refund.
Quick question can ltsb unilaterally opt to offset the refund against the loan without informing me first? If so it may help if I nominate a non lloyds account to accept the refund.
Hi sunandsailcat,
That's very good news - well done!
Regarding the matter of the loan(s) being outstanding, I had the same issue with Lloyds on two loan accounts but on one they said they would refund direct to me in the form of a cheque. When I queried why they could do this for one account and not the other, they quickly agreed to refund both sums as cheques which they proceeded to do.
I should add that both complaints did go through the FOS though and not only were the loan accounts still open, but they were also in default due to our financial circumstances having taken a turn for the worse.
Hope this helps,

Slightly mixed news today, wondering if anyone can come up with an explanation before i phone!!
Got another letter offering to settle with interest on one of my loans (thats 5 so far!) which is the good news!!
Another letter i recieved stated that the claim would be logged but i would have to wait till the outcome of the JR. Anyone know why they would pay out on all my loans bar this one???Liam :money::beer:0 -

Hi Liam
Is that actual one on an older one perhaps?
If so that may be the reason why for this.
Maybe someone else will know and confirm. The one and only "Dizzy Di"0 -
Hi All
I have one question regarding montly overdraft fee with Lioyds. I was told that flat montly fee of 5 pounds will come in force on 4th January 2011. Due to this message I had paid off my overdaft one day earlier and today I have got a montly statement from 04 December 2010 to 04 January 2011 including that fee. Can I claim my money back? or just ignore it.0 -
