    No doubt I am going to be controversial here, but four years ago, I too was diagnosed with BC. I had double mast, chemo, rads etc., As a member of Bannatynes, I dropped in and spoke to a member of staff and explained the situation. I did not cancel, but was given an extension to my membership of 8weeks free of charge.
    After surgery and before chemo, I started going back to the gym, the staff were fantastic, helping me with very gentle exercises to improve the damage caused by having lymph nodes removed, and preventing lymphodema. It also helped to boost my confidence when I was at my lowest ebb, money well spent.
    At the end of the day, it is a business,there to make money and no doubt there are countless excellent reasons for allowing members to end their contracts free of charge.
    I am not a member now, did not renew last year, but still remember their act of kindness.

    Unfortunately the webpage you post up says this
    Most sports clubs and gyms are not covered by the special rules,
    so they are quite within their rights to claim this as they do not fall under the 'special rules' as you state.


    Also as a aside to this - what about the person who breaks a limb? Do they get special dispensation from the get out of contract clause as they wont be able to use the gym either? Or someone else who has an illness that prevents them from attending the Gym? Where do you actually draw the line?

    Seems you have only quoted half a sentence which is very misleading

    The rest of the sentence reads "but are covered by the law relating to service providers. "

    So in answer to your question, the law is the law and Bannatyne Health Club does not make the law and nor is the contract above the law.

    Failure to comply with Disability Discrimination Laws can result in unlimited fines and compensations. In other words, that's a lot of gym memberships.

    i have not given any misleading information I have pointed out the end of the sentence which I believe applies. If you had bothered to look at the start of this thread you will have seen that i said pay it then try and claim it back..

    And as for getting around outrightly calling me a liar does this help !!!!!!?

    There are special rules for private clubs and associations that have 25 or more members. A private club is defined as one with a constitution that regulates admission to membership so that it is not open to all members of the public. Most sports clubs and gyms are not covered by the special rules, but are covered by the law relating to service providers. A club where members must go through a selection process (a golf club, for example) would be covered by the special rules.

    Jeff, you haven't posted any solid evidence at all. Rather more like figments of your imagination. The error message shown on your computer could be caused by something done by yourself.
