The solicitors went ahead anyway and the first we knew of it was when we received the letter from OR!!!

    May I ask how you are going about the annulment of your oh bankruptcy?
    Is it because you were not served with the necessary papers - statutory notice and petition, or have you decided to go down the route of an IVA?
    Since my bankruptcy I have been bombarded with letters about IVA as a means of annulling bankruptcy:confused:
    By the way, I think the bank acted in a despicable manner.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • Well!!

    I have found a way out of my problem with the two court claims and possible bankruptcy, then losing the monies allotted to me.

    In consultation with Myvesta, who have been brilliant, they contacted Grant Thornton and they are setting up an IVA for me with no payments attached, on the agreement that I pay the whole of my debt back on the completion of the court cases. IE I will be paying 100p in the £, in IVA lingo.
    You see, at the end of the day, the creditors are only interested in how much money they are going to get back - if I go bankrupt they won't get a brass farthing. If I go into a 100% IVA, they get all of it back, albeit in 2 years' time.

    So, I have been instructed to cancel my court date for bankruptcy, go into a £1 per month per creditor until they have officially set up the IVA and it is signed, sealed and delivered.

    Wow! I am impressed with Myvesta!!!

    It didn't bother me so much having to go into bankruptcy, more that I wouldn't be allowed to keep much of the claims from my court cases, one of which will pay out a lot of money.

    I speak with someone from Grant Thornton tomorrow, to finalise the details that they need and Myvesta are contacting my creditors to stop them phoning me (hooray!!!).

    What a relief to finally have someone who can actually DO something to help me.

    We got in contact with a firm called Bankruptcy Annulment Trust who arranged it all for us( for a fee of course!) and have told the or that they will pay the debt and then arrange a remortgage for us its only transferring the debt but it means we can keep house and also my oh is a self employed plumber and the bankruptcy is causing trouble in that reard also. We looked at remortgagin the house ourselves but u are not allowed topay off your own bankruptcy!!??!!

    Fingers crossed all will be well!

    I will stay around - you can't get rid of me that easily!

    Myvesta work with people from the 3 main accountants who do the voting for the credit companies, Grant Thornton, Price Waterhouse and KPMG.
    Whilst my IVA still has to be agreed, Myvesta said that Grant Thornton don't think it will be a problem.

    More when I know it!

    Hi - i am including a bank account in my br which is well in the red, having checked the balance i can take out 300 quid, which will max the overdraft, could i take it out or should I leave it there. Would the OR question why I took out the money knowing that I could not pay it back? Having said that it would help towards the fees - Please let me know your thoughts

    my advise would be to take it out and if the OR asks just say it was towards the fees or living expenses

    having just checked my online account tax credits have still not sorted out my claim, my baby is 4 weeks old, I was assured it would be done and sorted, now by the looks of it I will get bumper ctc and cb the week after br!!!!!!! I hope he don't take it all. I would have liked to have had all these figures for putting on my br forms but doesn't look possible at the mo.

    Regarding gambling on the forms, I have played a local lottery for the last couple of years and The National Lottery. £2 a week for two years = approx £200. Do I need to put this down as money lost?
