The Employment Claim is started. I owe money to the Solicitor which I ought not to have been charged in the first place. I haven't signed any paperwork to allow him to go ahead with the case. The bill is £575!
It says he sent three letters to my employer, but has ignored my requests to see the copies of them.
My Employment Claim is for Breach of Contract, but techically Unfair Dismissal. My employer says I have been not been dismissed, my Solicitor says that in action I have! I am so confused with all this now I don't know where I am at! I cannot wait until after discharge to complete this claim because there is a six month time limit on it, apparently.
The medical negligence I can wait until after discharge, that is not a problem.
I emailed another Solicitor re employment so am waiting to see what they say.
What a complicated carry-on! I am getting to the stage that I couldn't care less any more!
Wait a second Sandra - if the solicitor claims that you owe him money, why not dismiss him and include any claim from him in your br? Where can you check on this 'six-month' limit?I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

rog2 and sandralovescats you have got me confused with 'marwartooth'!!!!! they were the one asking about their THREE cars!! i was just giving some feedback on the parkers website...
And i was only trying to check the value of my car out of interest! -i bought it for £500 about 2yrs ago, and since then its had a few problems and done a fair few miles, so i think its probably only £300-£400 now and thats what i'm going to put on my form. Either way...its a 14yr old banger...0 -

Well, that is exactly what I am doing!
I haven't signed the paperwork to allow him to act on my behalf - yet, but I still landed a huge bill.
I wanted rid of the idiot of a solicitor that I have landed myself with so I spoke to another Solicitor via email, one of the no-win, no-fee variety, who told me about the six-month limit.
I have to tell the OR, in fact it might just help me out. I only worked part-time teaching but it would have been really useful to me now. My employer is claiming I am still employed, but I am not being allowed to do any work. The solicitor says it is unfair dismissal, which according to the Insolvency Service, the OR won't have any interest in. The OR is only interested in vast amounts of money from court cases! So if I tell the OR, he might be helpful to me! You never know.
I had got to the stage where I was just going to let the whole employment thing drop, because I am getting absolutely nowhere. Now I am in a position that I am not allowed to let it drop. But if I let it drop I will not be able to teach again, which saddens me greatly because I am really good at it, and I don't mean that to sound conceited in any way.
So, if the OR hands the employment case back to me, and I win the case, I still lose the money that I am owed, which was partly why I have to go bankrupt, and I am not allowed to keep any money given in compensation.
Given all that I might aswell just give up the fight now.
The trouble is, by the time I get to talk to the OR (which I want to be face-to-face) I am unable to discuss this without ending up in tears over the whole affair. I am just stuck, well and truly stuck.0 -
I have sent an email to another DMC, just to see if there is any way I can do what the OR told me to do yesterday. I can but try! See what they say tomorrow. Failing that all I can do is cut my losses and run.0

Just come back from the cab and they were very helpful. He advised me that he reckons bankruptcy is my best option, so its a phone call to the court tomorrow to ask them to send the forms.
Feels like I have a 10 ton weight lifted from my shoulders.
