Yes you need to do two forms for the insolvency service, one for each of you, and pay two fees unfortunately

Please ask away if you have more questions.

Would the OR mind our fees coming out of our overdraft (which I've allowed for) - so in a way, we're not paying them, the bank is - and then aren't getting their money back? How else can we raise the fees though?

Is there a certain value assests need to be before listing them on the forms (earlier I mentioned our TV but it's probably only worth £50 - £100 nowadays - cost £300 second hand bout 4 years ago)

  • Hi gooner

no i would not tell the creditors that your OH is going to apply for bankruptcy

Do you have a payplan ref num ?

    i

No don't have payplan as they just agreed with me BR was best. so didn't go any further with them.

I changed our phone number today any way as I can't be doing with phone calls over christmas ! (I know that a bit naughty but my way of coping!)

Why not take the br fees from a credit card in cash?

    I didn't do that and I wish I had!

    Don't worry about your tv
  • The Assets have to raise funds for the OR.

They are looking for flat screen tvs, cars, antiques, paintings, etc, or expensive computers.

Most ordinary folks don't have these things.

List your tv as an asset, but put the value as £50.

They do tend to take private pensions, ISA's, premium bonds, life insurance policies, etc.

Well since their phone calls are illegal anyway, I don't blame you in the slightest!

I have a computer system on HP - if I apply for bankruptcy, will I lose it?

Also my car is only worth about £600, will that go as well, considering the amount I owe is £2000?

I think that with HP the goods aren't actually yours until the last payment is made, so whilst the OR won't touch it, the Company may repossess it. Are you sure it is HP and not a loan?

My car is worth about £6500 and the finance is about £11000 and, apparently, the OR will hand it over to the finance company, so I guess yours will be the same. The car finance will have some fine print about going IVA or br and repossession.
Take some money from your cc or your overdraft and be ready to buy another car AFTER br, not before.

If the car was worth £2000 and was totally paid for, they apparently take that car from you but the OR would give you a lesser amount of money to buy something cheaper. This doesn't apply to either of us!
  • Thanks GIS
I might take you up on that offer ! sometimes its hard to tell even them close to you.
On here no one judges (even if you know yourself you are stupid idiot who has no money sense what so ever and shouldn't have spent the money on this and that) you don't always want people to tell you that. I spend that much time beating myself up about all this I don't need others to do it for me!
(Defences I think, when you at school/work to stop yourself getting bullied/ rubbished easier to take the mick and put yourself down it stops others doing it to you and hurting you.)
Think Im gonna go have a nice radox bubbly now (i know there are cheaper bubble baths but it was on BOGOF!! LOL)

I'm sure it's HP - I've had it on credit with Brightside.

Have been discussing bankruptcy with my hubby as i really don't think i have any other option, IVA's are out, we seriously don't have anything left after payday and are falling behind with bills.

    What's my member no.? :D
