  • Re Letters.

    I keep getting loads of letters from my creditors - and I haven't opened any of them.

    The first time I missed a payment on any of them was from 11th September 2006, which was when I applied to do an IVA. So, I have missed two payments, tops. The third missed payments start about 14/11.

    My br date is 20/11.

    I am now worried in case one of them decides to declare br on me.

    Is that possible in this short space of time?

    I daren't open the letters but then I am worrying because I daren't open them and I am wondering what is in them! Curiosity killed the cat and all that!

    Please can anybody advise?

    Hi Sandra - I don't see HOw any of your creditors can declare you bankrupt now. They would have to serve a statutory notice, which gives you 18 days to come to an agreement with your creditors - that already takes you past your bankruptcy date - and then they would need to serve you a petition that has to be served no less than 10 days before your hearing.
    There's no 'fast-track' in bankruptcy:beer:

    That has put my mind at rest!

    Glad that they cannot do anything fast!

    Mind you they moved fast with the letters.

    I sent a letter to all of my creditors last Tuesday, first class. I had written to them originally informing them I was taking debt management advice. The second letter was to inform them that it would all be sorted out by 20/11 although not telling them why! All the letters started up again, six in one week from ONE creditor!
    Do they think that this will make me pay up?

    I have been to the hospital most of today - got home and there was a message from MBNA - "You need to call me today on xxxxx ".They can go and get lost !

    I had a letter from MBNA myself, this morning, telling me that unless I contact them before the 14th, they are going to apply for an attachment of earnings order:rolleyes: :rolleyes:

  • Rog2 did you inform any of your creditors about your br, or have you just waited until the OR tells them? Did you answer the phone calls and tell them that way, or write to them at all?

    Not only was I self-employed - I am now Un-employed :rolleyes:
    Also I had informed MBNA TWICE last week, when they phoned, that I was bankrupt and that they were no longer allowed to contact me direct.

    Generally, I did not inform any of my creditors before I was made Bankrupt.
    I have, as above, told any creditor that has rung since that I am br and would be breaking the law by discussing their claim, as it could be seen, by the OR, that they were looking for preferential treatment.
    Whilst I have informed any creditor who calls, NOT to phone any more - this hasn't stopped them:mad: - worst offenders MERCERS (barclaycard), MBNA and Mackenzie Hall.

    Hi all

    I owe my local council more than £2000 in Council tax stretching back about 8 years. It's past the point where they will accept a repayment plan, it's now with the bailiffs and I cannot afford the amount they will accept. Apparently as my assets won't make pay off even a quarter of what I owe, the bailiffs will pass it back to the council who have told me that commital proceedings (prison) is an option, as is bankruptcy - now I don't fancy being bankrupt but I will do anything to stay out of prison.

    How do I go about applying for it with regards to my council tax bill? I can afford £100 per month but they won't accept less than £300.
  • I could be wrong but I think you cannot get out of paying your council tax bill = it has to be paid.

    Someone will be along shortly who probably knows more.

    Unfortunately it may not be easy. If the Bailiffs are involved, then I assume that there has already been a court hearing, often local magistrates, and they do have the power of imposing a custodial sentence.
    However, you could appeal to the court for 'time to pay' at the rate you can afford.
    May I suggest that you talk with CAB as you may need legal advice.
