  • right then, although i am taking advice from the cab can i just petition anyway?
    my debts are going up by 500+ a month with interest the letters and phone calls are starting again. tommorrow i need to break the link between me and other half or brv will affect him too - or so i have been told. Then I may well start the forms off online

    i got myself in now i'm going to get myself out and i have picked up some great friends on the way - cheers you guys!


    Yes of course you can petition without the CAB sayso!

    Make a start on the forms, it will make you feel better - I know that it did when I started my form online.

    Then, tomorrow, you need to phone the court and make an appointment - for the simple reason it will give you a deadline to work towards. If you are in London of course, there is no appointment necessary.

    where can i find the number for my local court sandra? I will phone them, in a way wish i had just done this before...................... but hey chin up!! lets just hope they do not jail me for fraud(lied to get the loans)
    I do have 4 kids!
    Not sure what to expect as I gambled it all away - and I hold my hands up to it and will take all punishment given.

  • Just put "xxxxx County Court" into the search engine and you will find the link to the Court website, with the address and the phone number.

    They will most probably give you a BRU, which means that your credit restrictions are lengthened somewhat - 1-15 years. If you have a look at the https://www.insolvency.gov.uk website there is a link to the listing of BRU/BRO and the whys and wherefores that they got them.
  • I don't understand this "lying to get loans" issue - to my way of thinking it is up to the lender to check the information that you give to them when you apply in the first place! They should share joint liability with you over this.

    Not sure about whom is responsible for 'incorrect info/lies' on application forms. One of the loans I took out from the bank was for debt consolidation. The bank person told me to write that it was for a car loan on the forms as it would be the only way that the loan would get approved!
    I assume he made extra commision from this. He was happy, I was happy so this is what I did. When you are desperate for money you follow the easiest advice even if you know it's dodgy !

  • just been to CAB and they have referred me to their debt department next thurs for an indepth look at incomings/outgoings.
    the possibility of me going bankrupt is 99%. if i have to pay off my debts at £1 a month for the rest of my natural i think i'll hang myself. it's the letters phone calls and threats which are really getting me down.
    i feel better today for seeing someone and talking face to face.
    wish me luck on my way to freedom and i swear to whoever, i WILL NEVER let this get out of control again

    You will be fine, Im not sure if i said this to you. But beware of what the CAB do actually say, sometimes they can be too 'helpful' for their own good and they do not always know exactly what you mean and the processes behind bankruptcy. They are very very good, but do remember that they are volunteers with other jobs/outside interests.

    Take a step back, try not to worry too much about all this and just look at the facts. The Law is here to assist in situations where debt is overwhelming, Thats why this law exists, to help.

    Everyone (almost) expands the facts on applications... The OR has not got the time or resprses to call every lender and ask what you said to them on application, I wouldnt worry and certainly wouldnt volunteer the fact unless asked...

    Hi, first post here.


    I've had lots of advice on forums and from Payplan via email over the last couple of weeks about going bankrupt and everyone seems to think it is the right thing for me to do. What I want to know is:

    1. Will the judge expect me to have spoken to someone directly over th ephone/in person about this?

    2. How much can I expect to pay back from my wages? I earn 1361 a month and pay £535 into my IVA

    I've just phoned up my county court (@ Brighton) and booked two appointments (1 for me and 1 for the OH) and the date earliest date I've been given is - Tuesday 6th March 2007!!!!!

    OMG - I've got 4 months of people phoning up and giving me hassle. :(

    I knew there would be a wait but not that long - guy on the phone said that they are really, really busy at the moment.

    Is there any other way to go? Can I use another county court or does it need to be my local one - I'd even be prepared to travel to the High Court in London if necessary as it's only a couple of hours away (if that)

    WOW.. What at wait, Id urge you to go to the high court if you have the funds aready and awaiting... its all over in a day !

    When you say you and your OH.. Was it a business that you have had, or is it personal insolvency that you will be filing for. Reason I ask is we were going for peoronal and we halso had a business together (a pub)... We were told to apply for partnership bankruptcy. means we can do it all together and there is only one fee...
