Well done pg - and thanks for sharing your experience. Has OR contacted you regarding any possibility of 'early discharge'?I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

OH and I went to court today for BR after a terrible nights sleep. We got there at 9am for clerk to go through the forms. I was v. worried that I had filled them in wrong but he said they were fine! He was v. nice and kind and then sent us away until 10am. We went and had a coffee and got back to sit in the busy waiting room for 20 mins.
I think we may hold the record for time spent in the court room. We sat down, the judge asked if we had taken advice on BR (yes, CCCS) and then pronounced us bankrupt. We left the room. We were in court for ONE MINUTE!!!
We are now waiting for the OR to phone us.
If anyone is worrying about going to court for BR, you don't need to worry it will be fine!
Now I'm nervous about OR but I'm not in the state that I was before court today (and the days leading up to it).
Thank you everyone on this thread for helping me get this far.
Congratulations - you made it.1/11/06 -1/06/07 BSC #42

I'm going to court 19th December and I can't wait!! Stopped paying all credit cards etc the day I decided to go bankrupt. Wish I did it ages ago. Its good to be able to read everybody else's accounts of what happens in court, dare say the nerves will set in slightly the day before but I know this is the best thing I can do for myself and my family.
I love answering the phone to Barclaycard, Capital one now(or rather their collections agency Buchanan, Clark and Wells. Now don't get me started on them , the Glasgow office.....what a bunch of bullying *******!!) The satisfaction I get telling them (politely) I have no money, going bankrupt so cheerio is fantastic.
Bring it on!!!
Peace of mind will make a great Christmas present!1/11/06 -1/06/07 BSC #42

Secondly, I would reccomend that you include the 'debt in dispute' in your bankruptcy, with a note to the effect that it is in dispute. In theory, once you have been declared bankrupt, the OR/trustee takes over ALL responsibility for your financial affairs and will decide on whether or not to pursue this claim.
Thanks, my plan is to defend the case, and whatever the outcome petition for BR, the case is for a small amount in comparison to the big picture, but it's a principle thing, I've paid, I'm not paying again, if the original creditor has stolen the money then it's their tough, I'm not paying twice for the load of crap I got.
But condsidering the childish anticts of the Claimants Solicitors this could go on an on, let's just say the Court Clerk went ballistic when they heard what they'd done last week and even offered to come and pickup the letter in person to copy it cos they were so annoyed at them.
Seems the Solicitor has his own set of rules that they work to.BSC Member 44 - not bankrupt yet, but getting there...0 -

Hi JGWT8M,
I do believe in the old addage, "he/she who laughs last, laughs loudest," if it was me I'd let the smug b******s win the case and then wipe the smile off their faces when you declare BKY, if it's not a secured debt you haven't really got much too worry. Far more fun th have the last laugh than cause yourself extra work by defending a case that's spurious at best.
Good luck,

Well, that's kind of the plan, there was a small balance outstanding so I paid it, they sued, I entered my defence, then they returend the cheque uncashed, as I said the Clerk went balistic when I told them, so unless they can convince the judge that the cheques and bank statements I've produced are fakes, they probably won't win.
And if they do, BR here I come.
And to think these are the kind of people handling house sales and divorces up and down the country, no wonder the UK stands for Unitedly Krippled now :rotfl:BSC Member 44 - not bankrupt yet, but getting there...0 -

OR is so busy that they will now phone in the next 2-3 days. So a bit longer to wait until it is really all over.
We're trying not to worry but it's the unknown which is scary isn't it. I can't think what sort of things they will ask. Is there anything I should be asking them?
Sorry, I thought there weren't any more questions!0 -

I didn't hear from OR for almost a week.
You can, and should, ask OR for clarification on ANY point that you are unsure of, relating to ANY part of the process from court to discharge.
The actual interview will be structured around the form that you filled in - point by point.
