    Anyway to the serious stuff, Advice apprieciated.

    1. Should i wait after xmas, basically begginning of new year to contact court for a date to go bankrupt and fill in any forms or do it now?

    2. My fist payments this month to cc, loans etc are around or after 15 of this month and so on. Should i pay in any money to show that i tried even though i wont be able to cover the payment and all my creidt is basicallyy hit the limit. if i do this i wont have money for court fees. i just dont want to look bad if i dont try making a payment or will this be OK?

    3. apart from my creditors i have one separate current a/c which is in credit £150-£200, should i remove the cash and close that a/c or do you think after bankruptcy they will let me keep it. its got visa debit card and has £250 free overdraft which cannot be increased or cancelled with a building society. its not a basic account basically due to overdraft but hasnt got chequebook.

    4.should i open basic account now or wait till after bankruptcy date? and any recommendations please.

    5 and finally my car is worth £2400 im worried they might take it, but i use it to get to and from work and also have a 18month baby which it helps having a car when going food shopping etc. is it advisable to change it to someone elses name in the family or is that dodgy? this is what really worrying me as i cant afford to lose my car.

    Right - here goes!

    1 If you are that certain , I suggest you make a start on your forms ASAP

    2 Don`t make any more payments - you will need the money for your fees. What`s the worst that can happen? they may give you a call but you don`t have to answer the phone .

    3 and4 We had a current account in credit wth 6 months good history. We spoke to them and they set up a basic card account to be used as soon as the current was frozen. We emptied the current account the day before the hearing and transferred all DD to new account with effect from BR day. This was with Barclays

    5 don`t try and fiddle the car. They will find out. Be honest about your neeed for a vehicle and you will have to accept that it may go. They may sell and give you a percentage to get a cheaper vehicle. This is all at OR discretion - there are no set rules on value or circumstance.
  • if your money coming in is benefits it is fine to open a basic account as benefits can take a couple of weeks to get it right! if you have decided bankruptcy is for definate don't pay any creditors anything! save the money!
    start filling out the forms now on line - as i have 4 children it was much easier for me to do them that way as you can keep saving them and go back to do more when you have the time.

    had a great chat with my or today who said yep take all the money out woohoo. I should only need a telephone interview as well which he told me is on the 11th at 9:30.

    hopefully all will be ok!

    So basically my to do list is:

    Dont pay creditors and remove money so enough for court.
    start filing the form which ill do 2mrw.
    leave the car as it is, it looks too dodgy, and what will be will be.
    I get benefits paid so ill speak to my bank to see wther they are willing to keep the account open or give basic account or wther they will close it.
    look at basic accounts if they say no.

    looks like barclays, nationwide and coop are the only ones doing for undischarged bankrupts which is what ill be when this is over and done with but ill see what my bank says.

    just one other thing do you have any debts with your currant bank eg loans or credit cards?

    If your account is a current account with cheque or debit cards , it will have to change as you will not be allowed this type of account. As i said we were on good terms with our bank so the transition was really easy. I hope it is for you.

    Congrats Alidadas...thanks for posting your 'run down' of events...we're (me and hubby) in court on Friday morning so you're put my mind at rest! We're further along the coast than you, but lets just hope we get such a friendly clerk as you did :) Well done on getting it over and done with...enjoy your new debt free status!!

    Very best of luck for Friday - take a good book to fill in the waiting around time as you will only be in court for 10 - 15 mins but will have to wait for your paperwork to be sorted after.
  • No the building society i opened the acount with the credit balance i dont have anything with them. the account has been opened only about 1month and half.

    i was hoping to at most to an IVA thats why i opened it. but after getting advise from payplan when they looked at my SOA bankruptcy is basically my only option unless i want to be in debt for 63 years at current SOA.

    so i wasted my time opening it
  • Well - It's Over!!!!

    OH and I went to court today for BR after a terrible nights sleep. We got there at 9am for clerk to go through the forms. I was v. worried that I had filled them in wrong but he said they were fine! He was v. nice and kind and then sent us away until 10am. We went and had a coffee and got back to sit in the busy waiting room for 20 mins.
    I think we may hold the record for time spent in the court room. We sat down, the judge asked if we had taken advice on BR (yes, CCCS) and then pronounced us bankrupt. We left the room. We were in court for ONE MINUTE!!!
    We are now waiting for the OR to phone us.

    If anyone is worrying about going to court for BR, you don't need to worry it will be fine!
    Now I'm nervous about OR but I'm not in the state that I was before court today (and the days leading up to it).
    Thank you everyone on this thread for helping me get this far.
