    Hi and thanks for all your replys.

    The advisor didnt charge me anything. And I have contacted CCS who were only advising me on my debts and they said to see an advisor. They also reckoned BR is the way to go now.

    What about bank accounts I know that mine will be frozen, who can I open up a new one with or doesnt it work like that ? soz for all the questions.

    Hi guys,

    Hope everyone is well!

    Just a quick update on our bankruptcy situation -
    - Basic bank account opened at NatWest - Step account - no bankruptcy clauses anywhere :)
    - Called Court - no appointment needed - lovely lady I spoke to (phew, I was worried about even calling them!) said 'just turn up'! :)
    - Paperwork all done online...two lots...gave myself a headache lol :)
    - Fees sitting on my desk, very sad to have to pay that amount in cash sob, but a small price to pay to be free finally :)
    - So...just have to go down there and make the leap...currently planned for first week in December as we have to move my salary payment, standing orders etc first. Also have to think of a plausible excuse to be away from work for a morning...any ideas??? I have no holiday left :(

    I've just come off the phone from the Co-Op and setting up a Cashminder Account with them - Phew, I got accepted... I was worried about that.

    Have you run your SOA by the guys on this thread? (sorry I do forget who is who there is so much going on here) Might be helpful to do that so you're fairly confident with it before you see the OR.

    I have the date, I have the cash (criminal to have to pay that amount really, but I guess its a small penalty for £43k), have worked my numbers out, just need to get them finally onto the online forms then print them on Tuesday next week ahead of my court date wednesday

    As for getting away from work for the morning, could you plan a doctors appointment about 10.30, so not worth going in before, and by then the dr is behind with appointments anyway, so who knows how long you'll be - If you get through court first thing and turn up at work around 11, they'll be impressed it didn't take too long!

    Also, aren't companies obliged to give you 2hours off to attend appointments that cannot be attended outside working hours (eg dr dentist hospital etc) - and most are a little flexible around that anyway.

    Thanks mboro - was a bit worried because there are MANY so-called advisors who simply prey on the misfortune of others for their own financial gain.

    this is the link Sandra posted yesterday........... I've just used it, its very helpful (successfully opened a Cashminder account with Co Op too - and made them confirm that it wont be affected next week when I go bankrupt

    Hi BizzyL - For what it is worth, I did not fill in those two answers on the form, simply because it was a case of 'where do I start?'
    Instead I took the form to my OR meeting and we discussed the answers to both of those questions in great detail. The OR condensed the discussion into plain English and put it on the 'statement' which I had to sign. She put it down simply and factually, whereas I would have been too emotional and would probably have missed the point.

    To take the second point first, this is quite tricky as there is no actual point I can fix on. In the last few months I found we were not able to buy proper amounts of food, or any clothes/shoes for much longer than that. That was when we realised there was no option but to seek advice and from there we are going br.
    Or is it the point when any income put in the bank account doesn't take the account into credit and you are living only on the overdraft - i.e there is no way to get into credit again?
    (I'll think about the 1st point later!)


    Basically, all they are looking for is for you to put your point forward - this could be divorce, loss of income, loss of employment, any change in circumstances, etc. Post it here before you write it on anything official!! Don't give the OR any rope to hang yourself with!

    For your second point you could always put June 2006, or whatever month you choose. The OR doesn't want to know about your overdraft - it is when you knew you had problems with your outgoings/incomings.

    Since my Bankruptcy Hearing, I have to say that, whilst most of my creditors seem to have left me alone, or accepted my statement 'that I have been declared bankrupt and they must wait until they hear from OR' I am being constantly plagued by MBNA (surprise, surprise:rolleyes: ).
    I have told them, on three separate occasions, of my situation. The last time was last Thursday, when I was contacted by telephone, by someone claiming to be one of their 'Senior Account Managers'. I repeated the statement and asked him to stop harrassing me, otherwise the OR would see it as an attempt to gain preferential status.
    Since then, I have received two emails, from MBNA - telling me to contact them regarding my account.
    This morning I received a very nasty letter, from MBNA, telling me that I have not accepted any of their offers of help, and despite the fact 'that they are putting in a great deal of effort to find a solution to my problems', I am running out of time fast. The letter goes on to threaten me with the possibility of a CCJ, siezure of assetts and ultimately Bankruptcy.:mad: :mad:
    Is there No internal communication within MBNA?:rolleyes:
    The biggest problem is that they are constantly telephoning, when I am not here, and it is causing distress to my wife.
    I have, as said, tried telling them, but they just don't seem to want to listen - any ideas please.

    Send as many of the time and date of the telephone calls, the letter, and a copy of the emails to the OR.

    I'm sure the OR will find time to make a phone call.
