please sunnyone. if you want to be certain of what accounts for critirea for HRM, do your homework as i repeat I did, and won my sons case for HRM in 2006 on his learning and behaviour, which comes under mental capacity, So not because he couldn't walk, as he is a physically fit and healthy 6ft young man of now 17, 15 at tribunal when he kicked my windscreen out and terrorised the clerk, but he can run' walk and lift me when i fall over, but also knock you down run into the road and cause mayhem when he kicks off, so stop arguing on an issue that you think you know and don't, as I have dealt with this in reality and have the paperwork in the loft to prove it...... its unfair of you to challenge this, when people are trying to get the right information to people who need it.[IMG]file:///C:/Users/suzysu/AppData/Local/Temp/moz-screenshot.png[/IMG][IMG]file:///C:/Users/suzysu/AppData/Local/Temp/moz-screenshot-1.png[/IMG]:A:smileyhea:heartsmilValkyria.:heartsmil:smileyhea:A0

my award for higher rate of mob and care expired in march, i sent them the forms in january, in june and after starting the official complaints procedure against atos for misconduct they awarded me lower rate of care and no mobility, i asked for another decision maker to look at the form and told them to write to my surgeon as i would no longer deal with atos and disagreed completely with the decision makers decision, yesterday i got my award for 5 years middle rate of care and higher rate of mobility, and didnt have any medical or meetings with atos, i do have surgeons reports and mri scans so i have provided indesputable proof of my condition BUT this proves that the DWP can make a decision when they choose to WITHOUT an ATOS report or medical0

Just to let you know I won the DLA appeal for my son today. They asked me a lot of questions about his needs/behaviour and then reinstated the award from the date they received the claim.Payment a day challenge: £236.69

Thanks Tobruk. I've spent a busy week gathering more evidence to send them. It turns out that the OT assessment I sent in wasn't looked at as part of my application, so I'm gonna put a complaint in about that. Apparently it'll take 11 weeks to get a reconsideration *sigh*I must go, I have lives to ruin and hearts to break

Well cwta, when I sent them a letter asking for reconsideration, it was dated and posted 10th March - they sent me a letter with their decision which was dated 10th April! You may hear within a month. I shall cross everything for you!;)0
