  • i am going through this just now too, i have pain and stiffness in all joints apart from ankles/feet and hands, have to use a stick to walk and even then i cant go more than a few metres before the pain really kicks in, yet according to DLA i can walk more than 50m without any problems ggggrrrrrrr, i spoke to disability direct and they put me int ouch with a woman from the council who helped me with the appeal form, i have sent his off and got word back a couple of days ago that after reconsidering they stick by their original decision so now it has to go to the tribunal appeal, so now i gotta wait for a date for that

    I just rang my council switchboard, asked for Welfare Rights and they put me through.

    DLA send them all the case notes, and then nearer to appeal time they house visit to go through the claim/extra info with you and explain what happens at tribunal (if it goes that far).

    It's taken me 11 months for my tribunal date to come through so there is a bit of a wait.

    HRM is awarded if you are unable to walk or virtually unable to walk.

    The higher rate care is given when a person is a danger to themselves or others, not the mobility.

    HRM is also awarded if you receive HRC and have a severe learning disability with behaviour problems.

    Should I wait til I get turned down? They're posting my claim today so it'll be 3 months (or more!) til I get my decision. I know that sounds pesimistic but I'd rather be realistic and put measures in place to limit how much it upsets me rather than be heartbroken and lost if I got a refusal.

    As I understand it you have filled in an application form (with the help of CAB) for DLA which is to be sent off today, is this correct? If so, I would wait for a decision before thinking about any steps you may need to take as a result of being unsuccessful.

    When you receive the decision for your claim, the letter will give reasons for any award, how they came to their decision etc whether it is good or bad news.

    Only then can you go forward if your claim is unsuccessful as they give you 1 month to respond to their decision if you believe it is the wrong decision and give your reasons why.

    I know it is very stressful. They normally send you a letter of acknowledgement for your application and on that letter it usually states that if you haven't heard anything within 11 weeks (I think it's 11) you can contact them to ask about your claim. The time they take varies - could be less and could be more than 11 weeks.

    Yep.

    The session was exhausting, even though she filled in the forms. I could do with a nap but ive got to wait for a parcel... and my doggy isn't helping by pressing all the keys trying to get my attention, this message took over 5 mins to write! :rotfl:

    formaldehyde_perfume, make sure you post it by recorded delivery and most importantly make a copy of the form as it may be useful for future reference - either with appeal or with re-application.

    The lady from CAB sent it off so I don't know what she did postage wise. I meant to ask her for a copy but I forgot, she mentioned that she always keeps a copy so when she emails me in a few weeks to see if things are going ok I will ask her to send a copy too.
  • You should get a letter from DLA telling you they've received it and to allow x amount of weeks for it to be processed.
