    I feel the same. I have filled in a form, but I'm not hopeful. Unfortunatly, I'm in the same boat as the OP, my GP & many of the GPs in the practice are rubbish & to be honest I'm seriously considering moving to another practice.
  • I personally know 3 people whose claims were rejected on renewal. I think they want people to give up, even if you are entitled to the benefit.

    Also everyone is getting turned down according to disability and equality and tribunal have a 7 month backlog because of this
    HRM is awarded if you are unable to walk or virtually unable to walk.

    The higher rate care is given when a person is a danger to themselves or others, not the mobility.

    It looks like they are getting tougher on new applicants. When I first applied I was given the lowest amount, but appealed and now have the higest on both components, but that was 10 years ago, and now we have all this cost-cutting........:(

  • I think I'm in the same boat. For my son's dla, they translated 'I take care of all son's personal needs' into 'DS1 can take care of all his own needs'.

    I've waited 11 months but have a tribunal on 28th. Went from MRC and LM to nothing, despite his condition not changing. Evidence I've submitted is a diagnosis report from his Aspergers assessment, psychologist report, and a couple of different school reports on support son receives - all of which backs up what I have written in the claim form.

    don't give up a few years back aspergers syndrome was re classed as not being a disability, but higher functioning autism still was for the unlucky kids, classed aspergers they started to get turned down, depending on who looked at thier claim I assume, but they can't argue the point and win, because the only way the clinical psychologists (best to diagnose, top of the list, cant be challenged) really can differentiate the two is, whether they spoke on time (aspergers) or speech was late (hf autism) as my cinical psychologist explained to me when he diagnosed my eldest son, whom was very hard to diagnose because of the complex nature of high functioning autism / aspergers and in fact if you read the critirior for both, most kids diagnosed with aspergers can clearly be seen to fit high functioning autism and visa versa, and alot of time it is easier to just say it's aspergers, as it can take years to seperate the two conditions, if you cant recall speech amongst other things, if anything the spite and malice found with aspergers is not so obvious in high functioning but still occurs so find out as much info as you can and and write a log of all behaviours even ones your embarresed to write about your own son, get all reports no matter how minor, and try and get support from social services disability team, community pediatricians, ed psycs and teachers and and welfare rights are brilliant also make it clear that aspergers is not curable and doesn't get better, write a complaint letter to DLA pointing this out, I did this with my youngest autistic son and finally at the age of 16 he got it indeffinately.

    He was undiagnosed when I applied, and the DLA made a big thing about him failing the first diagnosis we had done. I got the right hump and got him diagnosed on the second opinion, so in a way they did me a favour as I have an extra piece of evidence from people that didn't know DS1 before, saying the same thing I said in my claim form from last year.

    I'm looking forward to the tribunal. I have a welfare rights officer representing me...roll on tuesday.

    If you had read my post as I said I used this to challenge DLA and
    WON because thats is what they want people to think, do your research and you will see mental conditions also fall under mobility and not just care, if you are a danger to yourself and others, ie violent outbursts, no recognition of danger etc.
    I Have this in legal documents in storage if you look tho the info is out there I found it on the web after a few days searching, yes hard work, but worth it.
    it comes under their rules and deffinitions so dont state I'm wrong when I have dealt with this matter personally, and used the information to aquire HRM ( he was on LRM)for my son at an age when he was to big for me to restrain in the middle af the street in a busy town, because i couldn't have the car near to where we were to drag him too whilst he was kicking biting and punching anyone that got to close, mainly me because he can't control or understand his emotions
    I don't put anything on paper without knowing the facts
    by the way my boys are now 19 and 18 and still have DLA

  • I am seriously upset by all of this.

    I was turned down recently even though I am wheelchair bound, and can't walk even 10 yards without severe pain and difficulties. I also have a Blue Badge. My GP has given me a letter confirming that I have severe mobility problems, and yet DLA say that my GP says I have no problem with walking 100 yards!!!

    However, I have been told to avoid stress for medical reasons, and also have been told that the appeal procedure is very stressful!

    I'm running out of appeal time, and feel like giving up - they are certainly not trying to help people that are really in need!

    I spoke to the council (Welfare Rights Dept) and they dealt with all the paperwork. All I've done so far is collect further evidence and will be answering questions at the tribunal.

    Please don't give up. Give the council a call and they may be able to support you through an appeal.
